Hello,

Can someone please clarify this for me:

I was a named driver on my fathers policy, and I unfortunately had an accident, and my father claimed on his policy. All fine.

I now have my own car and policy, and my father will be additional driver.

What do I put under claim history, am I right in thinking the claim is under his name and not mine, or should it be under both, or just mine?

Does your father's insurer think he or you had the accident?

If the insurance question is similar to this:

Have you had an accident in the last five years?

Then I think you can answer the question. Yes, you've had an accident.

The claim is on his policy, therefore his name, but, the accident is in your name.

Depends what was said when the claim was made.

If your dad illegally claimed and said he was the driver when the accident occurred then the insurance company won't have any knowledge of you being involved. But I expect the claim was made honestly and legally and your dad submitted the claim naming you as the driver, in which case for insurance purposes, you have to state that you have been involved in an accident

You will have to check the wording on the application but I believe you will both have to declare it on the policy.

You will have to declare as being involved in an accident.

When you add your father you will also declare he had made a claim in the last 5 years as it was on his policy, it may offer a further drop down asking for the type of claim where your father can declare he was not the driver but still a claim on a policy in his name so it will be recorded

I agree this seems to be correct.

You do not have to declare anything when taking out a consumer insurance policy. Since the Consumer Insurance (Disclosure and Representation) Act 2012 (CIDRA) came into force, the onus has been on the insurer or broker to ask clear and relevant questions, and the customer must take reasonable care not to make a misrepresentation.

Just answer the questions they ask you.

There can't be many insurers that won't ask if you have had an accident in the last 5 years.

That is correct. The point I am making though is it is not for the customer to second guess the information the insurer needs. The insurer will certainly ask the question you suggest; all he has to do is answer the question truthfully to the best of his knowledge.

Think for a minute as to why they are asking the question, and you have your answer.
They want to know the level of risk that attaches to the person they are about to insure.
Your accident record will be one of the factors on which they base the premium they charge you.

Not quite, see my response above. It depends on whether the question is claim or accident. He had the accident, his relative was the insured party and therefore had the claim. In the OPs case he did not have a claim, his relative did.

Thanks for the replies - I think the simple answer is that the accident/claim needs to be listed for both drivers.
