So, car I owned for several years,(5 from memory )
Wasn’t using the car at all so reluctantly decided to advertise it , didn’t really need the cash or the space, just own too many cars and helps with the head space.

Advertised it in June this year, wasn’t really getting the interest in it, received a cheeky offer , some 7k less than any other one out there, considered it,my first thought was to tell them to do one, but the headspace etc made me consider, eventually we agreed a deal,

Fast forward to now (November ) the new owner has come back on to me saying they want a refund as it’s a cat d, now when I bought the car (2018) I hpid it and purchased it on finance , as far as I’m aware finance companies don’t lend on category cars, ( this was close brothers)
Before sale this year , ( finance had been previously cleared) I carried out due diligence and even though I knew it to be be clear, paid for an hpi check, again all clear.

I have the hpi paperwork from may this year, the new owner is saying it was a cat d in 2008 and want their money back.

Where do I stand ?

You could maybe help your cause by offering more details? Offer at 7K less? Financed by Close Bros? So not a £2K BMW chavmobile then?

With all the bad luck you've had recently (stolen TVR and also a stolen Aston), I'm sure at this level, you could ask your "legal team"?

Interesting, I presumed they meant it as advice for the OP to ignore buyer.

They did.

Surely the easiest thing to do is use a service such as Car Vertical to get a more in depth report than HPi provides.

If it’s clear simple.

If not, and the car was HPi clear when you bought it then you know what the problem is.

I wouldn’t be in a hurry to engage with this individual either way, but for the sake of £10 or so to give you peace of mind it may be worthwhile.

It could be the case that your old car was damaged & repaired but un-recorded.
It could also be the case that the car history agency have a glitch in their database.

But if the car was clean title when you bought it, and you know the history then it’s unlikely that anything is happening other than this guy is chancing his arm.

Wait for the solicitor’s letter, but don’t hold your breath.

How can one person who has only been on PH 18 months or so have several significant pieces of bad luck in such a relatively short space of time?

What does clean title mean?

OP been "clearly outed" and still people write genuine replies without reading anything but the opening thread.

Thanks guys , basically what I thought,

I have HPI paperwork for when I sold it, if they can come back on me then I can come back on the trader who sold me the car and he would just show me the hpi from when I bought it.

As ever on PH a few pointless ‘incendiary’ comments, still they give us something to laugh at.

Some checks show up more than other checks. Has the new owner maybe used vcheck and found it's been written off, but unrecorded on the database?

You're not having any luck with your cars.

Did you say to the buyer that it was hpi clear or not say anything on the matter?
If it is Cat D, then the trade seller has a liability to you whatever their checks told them.

No official designation. But I used it to describe a vehicle with no issues in it’s past that would affect it’s value compared to an equivalent model.

But you knew that.

Probably true, but I’d rather be friendly & naive than overly cynical.
I wasn’t aware of his posting history.

If I am reading it correctly, you sold the car in June of this year and now some 4/5 months later the buyer wants a refund?

So many questions.....

Thanks , friendly is always the way to get the best out of people, and my posting is very rare , just come on here for advice or to spread the word on 2 , yes 2 stolen cars on here, one of which has been recovered, in no small part to PH, just need to find the other still.

Oh, and it’s she not he, the clue is in the name, btw no offence taken, just clarifying 👍

I would think that clean title means there are no loans against the car and you have the ability to sell it.

I would expect it to mean there is no insurance tags against the car.

Finance will come & go but insurance categories stay on the car.
