Hey guys,

Bought a flat on behalf of my mum (to help pay care home costs), currently renovating, it’s pretty much stripped out and empty.

Was down there yesterday, a letter was delivered, seems bailiffs had been looking to recover £800 odd and explaining they would be back to force entry (good luck with that, it’s empty).

The client is HMCTS London, so it appears they do have a court order.

Clearly I just need to contact them, but what do I need - is my declaration that the person they were after is not at the address sufficient? I have an energy bill with my name on it, I could include that perhaps or the email from the solicitor when we completed.

The flat was purchased from a chap with a different name, he had tenants but none were the chap they are looking for, so they either have the wrong address, or the debt is going back some time.

Unless it's to recover a court fine or a fine from HMCE they can't force entry. So don't worry about that. Just ring the number on the letter and talk to the bailiff. They are usually quite chilled and friendly from my dealings with them. Explain the situation, offer to show them your ID and any other paperwork which proves the person they're after doesn't live there and they'll be happy with that and they'll refer the case back to their client which will be the last you'll hear of it. The bold 72 point red letters they hand deliver to your letterbox with their lines of threats are all bark and no bite.

No. That won't do anything and probably won't even get read as they'll get hundreds of those every day from actual debtors who are trying to BS them to get them off their back. It won't stop the bailiff from repeatedly showing up at your house. Pick up the phone and RING the bailiff. He'll have written his number on the letter. He is the person dealing with the case and he is the person with the powers to put an end to it. I'm confident if you speak to him in a civilised manner (ie. not threatening to have him done for harrassment if he doesn't stop coming round) and explain the situation, he will be quite amenable, especially if you offer to show him your ID/paperwork as proof it's nothing to do with you. smile

Ring the bailiff and speak in person !

Explain the situation, prove your I, offer to meet them at the flat at a mutually agreeable time so they can confirm 1)you are not the debtor and 2)the flat has been sold and is now unoccupied.

That gives them ample evidence to finalise things as far as that address is concerned and they can move onto more profitable work

I’ve, sent a mail before seeing the other replies, no issue, I will call them tomorrow.

I did include in the mail a copy of the council tax bill with my mums name on, and the email from our solicitor showing completion details.

I’m sure they looked through the windows, they will have seen the place is empty ( like really empty, no paint on walls , just bare plaster).

Reminds me of "Can't Pay, We'll take it away" when they revisited one chap, he politely let them in and the place had been stripped bare after their previous visit and threatening letters, his friends had clearly come round and taken absolutely everything!

Think best advice already given, call bailiff, he will likely have expected it to be a dead end, wants owner to contact and held hope some new information about his debtor could come from it.

That programme is excellent, but is concerned only with High Court bailiffs. I don't think they send letters, they just turn up and go to work. The letters would have come from some lesser outfit.

All sorted now, emailed and called them.
Had a reply yesterday stating they had now remove the address from their database.

Well, joy of joys, they’ve turned up at the flat again … despite an email from them explaining the property has been taken off their list.

It’s the company. The EAs only go where they are sent by………the company. They should have updated their system.
