We went out for a few drinks and a meal before Christmas and parked in a ECP managed car park on top of a shopping centre. The plan was to drive there, leave the car overnight as it's secure and locked overnight and then return the next day to get it.

It's one of those ANPR car parks where you enter your reg when you leave and it works out how much you need to pay.

When the reg was entered it said it didn't recognise it and asked to enter the entry date however the box to enter this was greyed out. We spoke to security at the shopping centre that said the system resets overnight as you are not allowed to park there overnight and you will get a fine from ECP which has promptly arrived.

We have pictures of the pay machine not recognising the reg and the field to enter the entry date greyed out and have included these in the appeal.

The PCN contravention is: No Valid payment permit was purchased.

The PCN does not mention staying overnight like the security chap advised and I also have a photo of the signage that does state the car park is locked and secured with no release available during those times but does not state you can't park overnight.

What do you chaps think the likelihood of the appeal will be?

The plate is perfectly standard as well, clearly visible on their letter.

It will more likely be successful if you appeal as the Registered Keeper and don't name the driver.

I had a run in with them and argued it and they backed down, they are, as far as I can tell a massive bunch of scammers looking to get folk for the merest thing with a sort of side hustle of providing a parking service.

My crime was going back as I realised my two hours were due up, getting another ticket that covered the next three hours but I didnt leave and come back.

So I said, can take me to court if you like, I am up for a battle but I overpaid so dont think you will win that one, and you can FRO if you think I am paying the fine.

They really dont want anything that involves effort, its just heres a fine, pay it and dont object, but if you are really stubborn and show that you arent going to just back down and pay it, then they lose interest.

The driver hasn't been named.

There was a drop down to state who you are and I selected registered keeper not driver and then referred to 'The Driver' in the notes.

It was the car park on top of Gosforth Shopping Centre on the High Street I am guessing since you are in the North East? The same thing happened to me there, although the machine let me enter the date and time manually and no payment required since I was there for less than an hour. It also failed to recognise another customer's registration plate when I was there a few days later, so the system looks somewhat error prone.
