Wrongly issued PCN

I had a PCN issued on October

First I heard of it was when lease company sent me some correspondence. Obviously by then any grace period had elapsed

I checked parking records on app and email. There's no record for that parking session on the app (there are lots of other sessions missing too) but there was a confirmatory email about the booked parking session

Session was when wife drops kid to school so it's kinda muscle memory

I appealed with this information and after about six weeks appeal declined. I sent them email proof that the parking session had been booked. I saw that the appeal had been declined when I checked online

So I appealed again and this time they've sent me a letter saying I need to pay. No reason as to why the appeal was not successful

What to do? They are chasing me for £110 for a parking session that was booked. I have given proof to support this.

I don't understand what is going on

Should I tell my local councillor?

Very odd and annoying.

When you say "booked" does that also mean paid for? So you have an email confirming that the parking was paid for? Do you have a corresponding debit on the card or whatever used?

If it was me, and I had the proof, I'd write a last time with a copy and tell them I wasn't paying and if they wanted to take it to court, that would be fine by me.

You don't pay for the first hour. And just the one hour was booked, but yea, there's an email from the parking people to say parking is booked.

I think I will do that and copy a few people in including the leader of council, portfolio holder for parking, my local councillors and the lease company

The devil will be in the detail here…

You say you’ve been issued in 10/24 and issued a PCN but whom has issued the ticket ? Is it the local council or a private company ? You mention appeals - is this through POPLA or their own service? Both are the same and they’ll be turned down as clearly has been done.

Are you holding a penalty charge notice or a parking charge notice?

You’re options now are;

1. Pay it. It’s £100+ and they’re out of your life for good. It’s horrible and you can rant or;

2. Invite them via letter to take you to Court - they’ll go down the small claims track / MCOL to scare you and you evidence the District Judge that all was well. They might not turn up - most don’t because they’re chancers but you never know. DJ’s are throwing this stuff out daily.

It’s Brinksmanship. A Chess Game. You can fight it and be told to cough up, or cough up now and it’s done with. Who knows the outcome.

There is no way I'm paying because I have full proof of the parking being booked. If it came before a judge, I know I'd win

I want them to realise their mistake and back off. I've tried twice but they don't seem to understand

I’d just write to them pointing out that you’ve paid and you won’t be paying again or engaging in any further correspondence.

Invite them to sue you, no guarantees but they probably won’t.

Unfortunately there are 2 categories that your predicament falls into:

You can't educate Pork.

You can lead a horse to water, but you can't make them drink.

If they won't listen just set out your proof to them again, tell them you have the proof & won't be paying and leave the response to them.

PCN cancelled after I wrote to the leader of the council, the portfolio holder for transport, my own councillors and parking enforcement.

I am pretty confident PCN would not have been cancelled without the email receipt my wife had which you have to opt in for. At the time of the PCN, I had not opted in for email receipts but obvs, now have opted in for all the parking apps I use.

I bet they have issued loads of rouge PCNs in this way.

Now to get my admin fee returned from lease company.

Great that you got the correct result.

With regard to the lease company fee, I doubt that you'll get much joy from the lease company (particular since they are an innocent party in this). Instead,
I would be inclined on making a claim against the parking company, on the basis of their negligence in issuing a defective PCN, causing you to have suffered a financial loss.

the email I got from lease company informing me about the PCN says that if you appeal and are successful then fee will be returned.

I've emailed them with the letter I got from council today. Hopefully they send back the fee

Might treat myself to a cheeky burger and fries. £18.

I reckon this is just a cunning roux to make you see red! It would send me ruddy scarlet I can tell you!
