I had a momentary lapse about 18 months ago and strayed to 34mph in a 30 limit. I had/ still have zero points on my license at this time. I did my dues and sat on a speed awareness course in the summer of 2023

I have received a NIP today for:

"for the alleged offence of: Exceed 70 mph motorway limit - automatic camera device.

My quesiton is, once I return my details to them, will I be offered a course again, because there's now a motorway educational course? Or does a course of a different type mean I will be sent straight to 3pts jail?

If the latter, anyone know the expected % of weekly pay I should expect for 86mph?

Will just be fixed (£100) and 3 points.

I actually got to do 2 courses, one I was caught in a variable speed limit zone and did the course, and then I was caught about 4 weeks later on a dual carriage way doing 70 in a van which for some reason is speeding

Did courses.

A very good chance you will be offered a motorway speed awareness course, they are run as two separate schemes.

I seem you be reading that you have to be caught under the variable speed limit to do an NMAC?

For clarity I was caught under a variable gantry, but by the standard camera on the hard shoulder and NOT the overhead

I was snapped doing 79 in a 70 section on the M6 recently. Was offered and did a SAC, the content was generic and not motorway specific.

Yes I think that’s the thing. There are distinctive different courses

SAC - for speeding

NMAC - for motorway offences

What I’m not clear of is if just ‘standard speeding’, meaning not whilst a variable limit was in place, on a motorway is a SAC or NMAC.

I’ve done a SAC within the last 3 years, you see

You can’t do a course until you reach 35 mph.
I have been on 3 courses as an observer. On every course there are people who state they have been on courses from 31mph to 34mph. But you can’t do a course at those speeds. Perhaps some people just get confused.

I’ll go find you the scanned copy of the NIP from the time, showing 34.

Meanwhile, whilst you’re waiting and since you’re an observer in these things, you’d fancy answering my original question?

It is technically possible, but without passing any judgement on your story, AFAIK in all these years nobody claiming sub-10%+2 prosecution has ever actually produced any paperwork, in England anyway. So for the sake of Internet trivia, please do actually post it up.

If you did a course you'd know why doing 70 in a van on a dual carriageway was regarded as breaking the limit

Where there is no variable limit displayed it is unlikely an NMAC course will be offered. £100 and 3pts fixed penalty is the likely offer you will receive. You can refuse that and take it to court where other points and costs will follow, unless of course, you convince the court you are not guilty or should have no penalty and endorsement applied. Good luck.

Nearly 12 hrs and still no sign of the alleged "scanned copy". coffee
