Refund issue

I order a gate from a DIY store(30th July) they seemed to be taking ages so couple weeks later(15th) I rang up and cancelled the order the chap said they will send a full refund within 7 days. I've just got back from holiday today and had an invoice pushed through the door. I phoned the company and they said their supplier delivered it on the 23rd. I'm guessing they have just left it outside the front of my house as nobody has been there. When I checked my bank they have only refunded me for the delivery.They are currently investigating. Where do I stand on this please as I'm guessing if I phone American express up they will say "it's delivered".

Write to them giving them 7 days to refund.

Failure to do so and simply call your CC company and do a section 75

After they said they would refund you, did you then order the gate from a different company?

left what outside the front of your house? the gate?

Did the courier at any point, have an option to specify "leave in a safe place". A lot of them do, but make you agree to bear their loss if its undelivered (or delivered then disappears). Not sure if that's completely legal (you can't opt out of consumer laws, etc) but there you go. And some couriers just do it anyway, without permission. And of course it could have been left with a neighbour and you weren't informed, so are none the wiser.

In any case, its up to them to prove it was delivered - which they will probably be able to do, albeit left in an insecure place.

I did not specify leave in a safe place. I would of thought that something worth £350 would not just be left like that.

No. I thought I'd leave it till I got back off holiday. The supplier will I'm guessing provide a photo of proof of delivery.

That's good to hear, I believe you have a strong case then. I am assuming, you had plans to securely mount the gate in a way that means it won't be easily stealable without tools etc?
