Got caught by laser @ 100mph.. claer sunny day light traffic... is this a istant ban? or points and fine ??
any advise would be good
Let's hope 100 mph is seen as a bit borderline and that a ban will not automatically be the result.
I would hope you've a good chance of getting nothing worse than a fine (though it could be fairly substantial) and a few points.
If I had my way you'd get no penalty at all, just a reminder to try a bit harder not to get caught next time. Best of luck anyhow, hardev.
Best wishes all,
Dave.
Yep On a motorway m40 j8, the hotspot everyone knows about except me !! the leaflet that came through wioth the summons said 70-100moph was in a bracket and the next bracket was 101-130mph was in another .. but they would not let me plead guilty by post and said I have to attend court.
Any advice would be appreciated thanks in advance

no need for evidance .. just unlucky .. should trade the bmw325 sport for a see lol ..
laser no argument .. 100mph on a motorway ..
just what gets me is they have all the paperwork .. cant see why they need a court apperance
wierd ..
not allowing you to plead guilty by post is bad news. The court appearence is necessary because you have to be present to be banned, it can not be done via the post. Suggests that the CPS will be asking for a ban. First offence would typically be 2 to 4 weeks.

In other words if you're going to exceed 100 mph, you might as well allow yourself leeway up to say 125 mph, and be no worse off if caught - or am I reading too much into this?
Best wishes all,
Dave.

My best advice would be to write a statement explaining all the circumstances (dry road, clear weather, no traffic etc) and a little descritption of how you know what you did, and you knew it was wrong etc, etc.
Good Luck !
^^^^^^Good advice.
It's also worth explaining that the car was fully insured, taxed, MOT'd and well maintained at the time of the offence. (assuming it was!!)
Top tip from a fellow PH'er, but thought it worth passing on
Thanks guys I really appreciate all the advise..
I think there is a ban heading my way or they would have dealt with it via the post they my license and insurance etc .. so the only thing they have is the speeding, but the leaflet sent to stated the first bracket was 70 to 101 .. although agreed that I was pushing the upper limit of that I was not in the over 101 territory ..
This could have easily been dealt with without the court thing ...
Guys I will on wenesday be back on and let you all know my fate!!!
I'm have to beg in court why I should keep my license, the reason I'm so bitter is that I pay my taxes and abide by the law of the land and I gona be dragged to court like a hardened criminlal ..
I broke the law, I admit it was not good to have been caught, but a difernciation sould be made between me and a criminal hoodie dude ..

My understanding is that after a certain 'threshold' (+30mph) then court is the only option, doesn't neccessarily mean you'll be banned but there is no option of a 'standard' FPN.
I was once caught @ 110mph, in a 70, but the cop put 99mph on the ticket and gave a FPN - but that was in the good old days before 'speed kills'.
Anyway best of luck (again)

??? CPS can't 'ask for a ban', or indeed anything else. They merely present the evidence - punishment is up to the magistrates. However you're right in that they want the OP to appear in court because there's a possibility of a ban, although it's far from certain.

thats my understanding. if your gonna be prosecuted for 71 might as well be 94. likewise 101 or 129
trafpol told me anything over 25 over went to court no matter what.

exactly. They're getting you in court because it is potentially bannable...not because they will. Agree with writing the letter, being humble, highly apologetic and hopefully points and fine instead.

yep. all rules should be ignored when appropriate. as intelligent adults we should chose when is appropriate.
good luck
