friend of mine doing a 3 point turn clips a fire hydrant sign, she gets out and has a look, sign is un-damaged,slight graze on her front bumper....she drives off.
2 months later 3 seperate envelopes plop through her letterbox, they are 3 seperate summonds for criminal damage/failing to stop after an accident and driving without due care?????????????????
seems a rotten gate and fence 12 feet further on than the sign are falling down and the houseowner wants a new fence and gate.
she has a solicitor who seems worse than useless.
question is why are police persuing this when there is no evidence to show her car got anywhere near the fence, she has the car and photos of the fence to show she didnt do it.
answers on a £5 note please.

Rabbit somewhere...

Plod/CPS, despite what is thought of them, do not issue summons willy nilly without enquiry and interviews. They will have done this and it would appear they have amassed sufficient evidence to proceed.

They didn't even interview her before issuing a summons? How do they know without interviewing her, that it was her driving?

I'm assuming they had a witness, but wouldn't she have to at least be spoken to by the POlice before a summons is issued? I'm .

Not the first very similar allegation made on this Forum. Summat afoot. Trying to get detection rates up to national average perhaps? Should stick to drugs offences ... 100% detection record (or it should be!). Why? How? You work it out! - Streaky

My advice would be to get a *good* solicitor.

To make any of the charges stick the CPS will need the witnesses to come to court. Under the circumstances, a good solicitor should be able to get enough evidence to show that the fence owner is trying it on, will be able to trip them up over the fact that they are trying to get money out of the situation.

This will be the reason why the due care and attention would be bought, so that its worth the CPS time to follow it up. Whilst they are doing that a criminal damage case becomes easier. Once criminal damage is proved it makes it very easy for the fence owner to mount a civil case to get the cost of a new fence.

Sounds like a setup to me. A good solicitor will go to the scene and take accurate photos of the fence. There will be no evidence whatsoever to prove the car hit the fence such as paint etc. That would be my starting point. Once the witness is discredited on one count, there testimony becomes less valuable or worthless.

Edited to add: If I were the solicitor I would investigate the councillors position to arrange some suitable questions on how exactly they reported the supposed crime, and to who. Did they report it in a general way, or did they ring someone they knew? All the better to disprove the story and show it for what it is.
