Caught speeding by front facing camera in a company car. My bosses viewed the photographic evidence and since the picture is not crystal clear and its not absolutely clear who was driving the car at the time they have told plod that they suspect it was me so the ticket is now on its way to me.

It will be a court appearance for sure. But i want to know what my next move should be once the ticket arrives at my door. This will be my first offence so i'm not really up to speed (no pun intended) on the procedure .... and if they're is any way i can escape 6 points and a fine, I'd like to know how !!!

The circumstances were as follows....

9am saturday morning. The only vehicle on that strech of road at the time. Two lane 30mph limit. Two coppers in um-marked bright yellow jackets pointing the divice down the road. Cable from the device running to an un-marked white van parked near them. No warning of them using camera equipment on that strech of road and no plod signs to be seen !!!

Can they do that ??? Am I clutching at straws here ???
What should be my next move ???

Will owe any helpful PHer's big time if they can help me out !!!

Go to court and tell the magistrates it's not fair - you'll be fine.

How fast where you going, by the way?

Why the automatic assumption of 6 points ? As asked, at what speed were you alleged ?

Fast enough to get six points (worst case scenario) unfortunately. I and many others assumed the road to be 40mph. Turns out not to be the case ! Lucky me I got to find out the hard way !!

Theres gotta be some way to trip up plod ..... i promise i'll be more attentive of speed limits in future ! Help !

What's an un-marked bright yellow jacket? Didn't see them then?

Bend over and take it like a man.

At the end of the day you were speeding, we all make a choice and should accept the consequences.

Treat it a a lesson learnt and pehaps take a course such as IAM which will improve your observation.

After all, you didn't realise what the speed limit was and you mustn't have seen the coppers in high viz jackets stood at the side of the road. Had someone been about to cross the road would you have seen them?

Sorry if this seems negative.

Yeah very helpful fellas.. My observation is spot on. I was implying that the fact that they were copper's was not at all obvious (and from other posts i've read.. it should be) !! I could see the bastards quite clearly but what wasn't clear was that they were in the process of recording my speed.

The road was empty, no pedestrians (and there never is on that strech), no nothing... just two scumbags trying to make some money. Oh, and an idiot driving at a sensible, safe speed !

You saw two fellas at the side of the road wearing high viz jackets and it didn't cross your mind they might be bib.

You say you thought the speed limit was 40mph but it was actually 30 - not great observation is it?

Phill.. Your comments are about the least useful anyone has ever recieved in the history of this forum !!

The reason I didn't react to them is because the previous day the council had sent out their traffic recorders on this strech of road. You know, the scruffy folk in high viz jackets with clipboards... Anyway this is exactly how plod was positioned and exactly what i mistook plod for .. until I noticed the tiny speed recorder in his hand at the eleventh hour.

Now i don't know about you fellas, but that strikes me as little bit underhand and sneaky !

With more and more people wearing Hi vis jackets I can see this happening more too

soon we will be ignoring men in bright yellow coats just like we ignore speed camera markings and signs cos so many of them are bogus too.

I think we should all just pay our fines and take our points and carry on driving when we lose our licenses.

(unless you get done for Drunk driving or what have you)

They can not jail us all, and what the hell else can they do to keep us off the road?

What, you mean in the whole six months youve been a member.

The fact remains, you still thought the road was a 40 limit and it was a 30.

As I said before, poor observation, your fault nobody elses.

I take Hedders point, but if your going to ignore warnings no matter how bogus they may be you are increasing your chances of getting caught.

Sorry for not beind "helpfull" but I'm getting a bit pissed off with this blame society where everything is someone elses fault. The fact is you were breaking the speed limit, you know the consequences, you got caught. Tough break, hard cheese...live with it.

Before you ask, I got caught on an empty dual caridgeway at 8am on a sunny morning in a temorary 50 speed limit set up for non existant roadworks doing 58.
Did I moan and wriggle and squirm?

Well to a degree, I lost the NIP, wrote the police a letter and generaly got my £60 worth of admin, but at the end of the day I bent over, took it and have made sure I've kept my eyes peeled since.

What I'm saying is just learn from your mistakes.

If you get the opportunity, or can get the opportunity, accept it at the earliest time possible, whilst the 3point and £60 penalty is still offered.

At court, the penalty would be 3 or 4 points at worst, but the fine would be slightly larger, and you will have to pay costs.

Your chances of winning the case outright are less than 5%. That is an exaggerated estimate too. Once you have that in mind, it would be best to withdraw from the situation with the most points left on your licence and most money in your pocket.

You still havn't said how fast you were going.

Even if you mistook a 30 for a 40 and were doing 40ish, you'd still only be looking at a fixed penalty and 3 points.

So you must have been doing high 40's (probably indicated 50 on your speedo), if you're assuming 6 points ??

You may well be right. 56 in a 40 is bad enough.

Well spotted!!!

It was one of those 'this happened to a good friend of mine...' stories!

for 40, 3 or 4 point at court would be the going rate. 56 in a 30 is 6 though.

Unless we really are talking about two separate occasions?

Not necessarily so, I got 3 points for 57 in a 30. Some (most?) limits are ridiculous and exceeding them by large amounts can perfectly safe. Out in the sticks where I live we have a nice wide A road with a 30mph limit and numerous B roads only 1 1/2 car widths wide leading off it with NSL. Guess where the speed cameras are?

I completely agree with what you say about the limits, but was the 3 points you got decided by the magistrates, or was it a fixed penalty. Otherwise, it is the case for 27mph over the limit in a 30 you got 3 points and for me doing 22mph over the limit in a 70, I got 6 points!?

take the points its your first 3 - you're screwed anyway. if you fight it (thats an even bigger crime in their view) you'll get more.

and as I was told (as an after thought) by highway patrol in Kentucky as he walked away back to his car leaving me $216 lighter.......'AND SLOOOOOOOWWWW DOWWWN!!!!'
