Morning

Got a NIP in the post yesterday morning for doing 39 in a 30 in south london at 18:34 last monday.

I think that's a little low to be honest, as to get from finishing work in Newcastle down to London in an hour, I must have been doing around 300mph.

I assume I need to write a letter to the met explaining the circumstances and asking for the photo, and then call the police if there is another car with my number plate on it?

Yes, respond along the lines that you cannot provide the required information as you and your car were in Newcastle at the time of the alledged offence. Request a copy of the photo as you are concerned about the possibility of a cloning situation. Don't forget to keep copies and send the reply recorded delivery.

Possibly worth mentioning that you are keen to comply with the requirements of S172 but are unable as you couldn't possibly know the driver. If it was me I would ask for their advice on how to proceed and appear as if I didn't really know what's going on. Always appear to be helpful and keen to comply while pushing the onus back to them. It helps if they are daft enough to persue things should it ever come to court, which I'm sure it wont.

I'm going to post the following letter I think :

Dear Sir

Regarding the attached alleged offence of EXCESS SPEED (30 MPH RESTRICED ROAD) of 39 MPH on 13-NOV-2005 at 18:29 hours at Footscray Rd DA15 Wst of Harland AV EB (4528).

Both myself and the vehicle described in the offence (XXXXXXXX) were at the following address at the time of the offence.

xxxx
xxx
xx
xxxx

I had left work in Newcastle at approximately 17:00, and as such it was impossible for either me or the vehicle in question to be anywhere near London.

I would be happy to take a look at any photographic evidence you would like to give me, to ascertain the cause of the confusion.

I am concerned that my vehicle may be a victim of a cloned number plate and would appreciate your advice on how to proceed.

Yours truly,

havoc

Looks fair - short and to the point, but helpful.

Good luck. TBH, if you've witnesses putting you at work at 5pm, they can't stick it on you, but the cloning situation is the most concerning thing - get that reported ASAP.

Yup, I've got a few witnesses and also have an electronic key to get in and out of the office, so could probably get records pulled from that if need be, but I hope it wouldn't come to that.

Not too worried about it to be honest, but i'd rather it got sorted out as easily as possible. As fun as winning a court case would be, I don't really have the time

I'll just call the police about the cloning if the photo turns up anything, my gut feel is thats it's just an error, but we will see...
