Briefly, I paid for rooms in a hotel in Milan on the basis that it was air-conditioned (as advertised). It wasn`t and it spoilt my weekend! Can I go for them under the sale of goods act?

Hi,

The Sale of Goods Act is only for contracts in the UK. I also believe that compensation with regard to failures under the act is only if you have suffered injury etc.

The other factor will be that when you booked the room you would be subject to the companies Terms and Conditions which will probably have a section which will cover your answer on what can be done.

The other factor may be before you resort to 'legal speak' is just talk to whoever you paid the money to and complain in a polite way and see what happens?

Just found this on lastminutes T&Cs:

What this means is that the contract for the product is between you and the supplier. In most cases this will mean that there are additional terms and conditions governing the contract as each supplier will have terms and conditions relating to that product. Please make sure that you have read these terms and conditions before completing your transaction with us. You can easily request them from our Customer Services by using one of the methods detailed at the end of these terms. Where we act as agent this will mean that we have no contractual liability to you in respect of that product. However, we may still be liable to you if we have been negligent, we have misrepresented important information or have been in breach of any other relevant law.

There you go!

Contact Lastminute as you have been misrepresented.

Thanks for the info.

I have been in corespondance (one r or two?) with LM, but derisory "goodwill gesture" is all that is being offered. Really want to take it forward because of their attitude.

I know it was a cheap shot apologies but merely trying to illustrate that we have all been on the receiving end of a rip off merchant at some time or another.

Hope you get it sorted Towman.
