A good friend currently has 9 Points, all of which are three different offences (3 x encounters with Mr Gatso)...he has now been snapped again and another three pointer is on the way.
can anyone help in providing information which he can use in his defence in an attempt to escape a ban?

Join the Police ?

Failing that, try Pepipoo, see if there is an *out*.

I have heard that you can claim another member of your family was driving for example, but this is against the law so I'd strongly advise against it.

Unless your name rhymes with Clair, Glunkett or Sandelson it's probably impossible to avoid responsibility if caught red handed.

Be prepared to fellate the magistrate...

Basically, to avoid it, he needs a compelling argument, like loss of job etc

I would strongly advise against letting someone else take the points if his job and home are at stake for this heinous crime.

Do not get them to name someone else on the NIP whatever you do. And definitely don't chat about it on the net afterwards, not that they would do it anyway.

Interestingly, I saw a bloke from the scameraship the other day. He said the cameras must be working as there are less bans now. People get to nine points and then stop offending. Wonder why

Yes, getting his wife, sister, mother brother daughter dad etc to take the points would definately be a silly idea, and one I'm sure that no-one else would ever dare even think of doing.

Joking aside, the penalties for Perverting the Course of Justice and/or Perjury are far higher than those for speeding offenses. So you really shouldn't consider lying on a legal document by stating that someone else was driving.

If it's a simple Gatso from behind then there's no way the SCP scum can know or see who was drivng, it's pretty much impossible so to give Wife or Brother is fine, they will never know and can't prove it unless wife/brother was dead/overseas or in jail at the time . . . of course it's illegal but so is the way Bliar and Brown are stealing money and jobs from us . . .

It's not a bad idea to make sure the person you name is insured to drive the car and was in the same part of the world as the car at the time.

so to give Wife [the] fine
Blimey, I'd be in her debt for eternity and she's make sure I knew it. If it were me I'd rather have the ban.

(Sorry darling, if you're reading. )

Switching the points is a terrible thing to do..... then again the SCPs aren't interested in getting the offender they are only interested in getting someone... anyone! If they have a million offences a year recorded then they want 1 million convictions. They couldn't give a monkey's if 90% of those convictions were false....

I hope you gave him a 'slap' from all of us.....

But can't you claim 'undue hardship' at least once, provided you can show it to be true?

Look (search) for the post on here by Justinp that defined hardship very succintley and inwardly digest.

The other way but could involve a short ban is to ask the Magsitrates to deal with the offence on its own under Section 34 the discretionaty disqualification (leaving the Section 35 totting alone) it attracts, normally a short ban. Left on the Licence are 9 points as a deterent.

Do what you must

However, I'd suggest getting a Road Angel now as well, to really help you out. Just stay slow now, it's all you can do unfortunately

Stay slow, stay safe

Wouldn't honestly worry about legalities. The whole legal system regarding speed limits and camera's and such is a joke anyway. Safety my arse. Do it on principle, not on fear of a law that protects a stealth tax!

It has to be said that with his licence hanging on three points he should have taken more care and not got snapped again.

Hi,

Unsure of how successful a mitigation plea would be. I have heard of cases from 'sorry I am blonde and I wont do it again I promise' being adequate whereas in other cases even losing a job may not be adequate. This is one of the 'interesting points' of our legal system that our magistrates who do not have to have any legal training, run on basic guidelines and all the rest is just their personal feelings.

If you have some spare money lying around like about £700 to look at a case pre-court and about £4000 to represent you if you go to court there is at least one very good specialist solicitor I can tell you of who has a near (if not exactly) 100% record in traffic cases. In a sense, everything can be bought. What I have found over a couple of cases is that sometimes, reasonable honest methods of winning a case are rejected wheras I would have been much more successful in making the CPS do a lot of work where they would eventually make a mistake that could have been capitalised on, or merely find a loophole without perjurising yourself whilst still making the CPS prove their case in a way you know will be unsuccessful.

I have no sympathy with anyone getting caught by a Gatso 3 times.

Specsavers is their best bet

Leap up, slams right heel into ground, throws up right arm to finger touch forehead.

Commander Sahhh.

Max fine of £1000 and 3 points. NO pokey unless cannot pay fine.

Sahhhh.

Again slams right heel into ground, right arm wave, back down, pirotte and departs left, right, left, right, farting profusely (military beans and sausages - not a good meal mixture.)

I stand corrected!

Very good, Corporal.

Carry on!
