It seems that councils cant just stick a fine on you for parking etc as you have a right to have it heard in court....i cant remember the relevant law etc but seem to remember a guy who successfully challenged them as the law was never updated/changed since gawd knows when. Hence it still stands.
Applying this to other agencies: Can DVLA (amongst others) just assume guilt and fine someone with a FPN for non declaration of sorn etc without it going to court?Can they be challenged?

Yes they can.
Under The Road Vehicles (Registration and Licensing) (Amendment) (No. 3) Regulations 2003 if Licence has expired and SORN not declared they can levy a fine of £80 (£40 if paid within 28 days).
