contesting speeding fines
Discussion
a popular (not) question for the PH masses...
i was supposedly clocked doing 40 on a 30mph dual carriageway (downhill to make it even worse). i remember looking at the speedo when it flashed, quite surprised as i was following the two cars in front of me at the same speed.
i'm adamant that was not doing 40 - problem is i can't say i wasn't doing over 30. is it up to Them to prove that i was doing 40 (and not say 33)? worth contesting or shall i just roll over and take it as another form of taxation?
Contesting these type of things is a bit of a minefield.
I got told I put up 'the best self-defended case in 20 years' when I defended myself and still lost, as did my barrister on appeal.
However, I have been helping a guy from PH get his case together and what to do, as more points wouls have meant he lost his licence and job. The CPS were a joke when it came to organisation and sending him evidence. However, when it got to court the officer admitted that the reading *could* have come from another car. He also brought with him the newspaper cutting of the reports about the LTI2020 device which the magistrates read.
He was found not guilty! The Daily Mail are also running a story about it I think as he was interviewed this week, so keep you eyes peeled!

If its a Gatso get the Photo's. Check the distance between the two photo's. (They should be Marks on the road which you will need to measure the distyance between). Then pop over to Pepipoo and get the formula for calculating your speed. If it's below the claim I'd send them the evidence, (calculations etc) and challenge it.

ah thanks. couldn't find my post, just realised there was a separate section for erm (alleged) sinners , doh!
anyway, the NIP says that i cannot see the camera pictures unless i contest in court?
so i have returned the form and am awaiting the letter regarding fine/prosecution - think i'll be seeing them in court.
really peeved off cos i've had 0 points in 12 years of driving. it's not the fines that matter, it's the fact that i feel they've bumped up the speed to 40.

it's probably a bit late if you have returned the form but you might want to read this about the photos

Cambridgeshire Scammers were quite happy to forward me photos of my car when I asked - they even have a bit on the NIP giving the number to ring if you want to see your photos. I must point out that I categorically statethat I was not driving at the time of the alleged offence, nor can I confirm at this time who was driving.

just to clarify, i thought the NIP form was just to confirm whether you were driving the vehicle etc. and you have to complete it anyway. (and i'm not disputing that i was in the car)
the form (from Surrey scammers) has no information / explicit contact details or anything that would suggest you can get hold of their 'evidence' ...

Technically, you are not obliged to see any of the evidence against you until you receive a summons and a plea of Not Guilty has been entered.
Prior to the return of the s.172 form, most SCPs will generally send a copy of the photos if you ask them nicely - to assist in identification of the driver, for instance
. As your s.172 has been returned and you nominated yourself as the driver, it is almost certain that the only way you would get to see the photo(s) now would be to ignore the Conditional Offer of Fixed Penalty which will be coming your way. Failure to respond to the CoFP is pretty definite to result in a summons being served for the alleged speeding offence - service of summons likely to be 5-6 months after the offence.
