Who says he wasn't qualified to drive a minibus?
All it says here is that he was found guilty of careless driving. His penalty was disqualification for 6 months.
hmm, must have made a bit of mistake there, I had a phone call between reading and responding.
Still if he was not isured it still suggests there is reason to pursue the operator.
If i knowingly allow someone to drive my car and they kill someone i am sure i would be prosecuted.
BBC Wales news at 6.30 reported that he was unlicenced to drive that vehicle - I assume from that he had a Car licence but not one for Mini-buses - not sure what the classes are but they are different.
Being unlicenced any insurance would surely be invalid - hence the no insurance charge.
Apparently he wasn't a regular driver and was 'only helping out for the day'.
Still we know now that driving carelessly, without a licence and insurance and ending a young life is valued at about the same as driving safely, with a licence and insurance but at 30+ mph over the limit on a clear motorway.
Whoever said the law is an ass was doing asses a great injustice

Shows what they really 'think of the children'

Just read this thread, bit late now, but it would have been interesting to know if the mini bus had seat belts, if they were worn, and would they have saved this poor girls life assuming she wasnt wearing one.
Tragic to say the least.
According to BBC Wales news reports throught the trial, there were seat belts fitted but not neccessarily being worn.
The was a female 'adult chaperone' on the bus who stated in court that; "....... it was not part of my duties to ensure that seatbelts were worn."

Seems to me that a) children should be educated with some hard hitting videos, case historys etc why they should wear seatbelts, and b) someone should have the duty to ensure they are worn.
I wonder if this unfortunate accident has changed anyones views on the wearing of seat belts on school buses, probably not.

I work in a school - not as a teacher but on the pastoral support side and it's not always as easy to 'educate' some children as some may imagine. Not going to go into the reasons why here - it would take too long ans is TOO far off topic
With regard to someone having the duty to ensure that seatbelts are worn, I thought the law already covered that one - the driver. Perhaps the CPS were so confident they could make a Death by Dangerous stick they didn't bother to put any other back charges.
I'm now waiting for the civil action against the company/driver/LEA to start which I suspect it will shortly.

The justice system ist all wrong. Mad Doc post on Paul's site about the 18 year old Corsa driver who killed a 9 year old in Bolton. Ist a 40 mph road und not 30 mph as reported by the "Wail". 18 year old had been driving car at reported speed of 50 mph. No one ist exactly sure if and when he drove at the 60 mph as also reported.
He hits girl, panics, runs, tries to get a pal to give a false alibi und then turns himself in after 11 days of "panic und guilt". He ist remanded. Behaves himself.
Judge bans for two years und jails him for 12 months for killing the girl und 3 months for running away. With remission for his good behaviour - he will serve just 6 weeks. Also judge says "speed margin was not grossly over und dangerous was marginal."
We think the other drivers were also above this 40 mph limit given the judge also say that these drivers all saw the children crossing und stopped. He did not.
In another case also in this area but a different judge und court - guy plead not guilty to careless driving. He knock over 13 year old in 30 mph zone. He say he drive 35-40 mph und see her und brakes. She freezes - he misread her - she also maybe misread him as she continues to cross - und he does not brake again to stop. He swerve around her und clips her with his rear side panel. She stagger back - she sadly falls und hits her head against edge of kerb und dies later in hospital.
He ist very remorseful in court but denies being careless. Judge disagree as he think from his own admission there was ample time for him to bring his Astra to halt in time. He fines him £750 und 6 points but does not ban or jail because "person need to drive for a living." I think at very least there should have been some order for lessons as "driver had limited experience" per the judge in the paper as well.
I think these should have been given separate threads. as well
for debate.
