I listed my car on ebay. It was sold but the buyer never contacted me and never paid. I opened a Non-Paying Buyer report which they automatically closed without consultation.

As it happens, there was a problem with my credit card and they were unable to take the listing fee. You've guessed it. Even through eBay oversee their own system, they still consider it my responsibility to pay the listing fee.

I'm nowbeing chased by a debt recovery company.

Have I a defence or should I just pay?

I'd appreciate a legal viewpoint.

Thanks

If the buyer doesn't pay, you should be able to claim the final value fee back. The listing fee still stands.
