Hi folks,

Not related to being on the road, but need a little advice if anyone can

Moved out of house 8th April this year. Sadako phoned them up and said we'd moved out. The local council issued us a bill for some weird amount, £24 something, which looking at it is basically 8 days council tax.

All was well and Friday a letter comes through the door in my name that was originally sent to the old address. I open it up.

It's a court summons to appear in the local magistrates court on the 24th of last month because I haven't paid the council tax for April 2006 - March 2007. Obviously I missed the court date as they'd sent it to my old address.
Account numbers are the same for the summons & the final invoice.

I've sent them a quickie e-mail which they've said has been forwarded on to the right department for further investigation.

Anything I can do to get this sorted sooner rather than later? As I take it I now have a CCJ against me and portentially bayliffs on the prowl?

Don't bother with the council, write to the court with copies of information regarding the move, including any correspondence with the council. If you wish to contact the council do it though the chief finance officer and copy a councillor demanding compensation for the smear on your character, Start your letter to the court with an apology in that the post has finally caught up with you. Magistrates generally do not take kindly to mistakes by councils, especially if you impress on them that you have had no warnings from the council before summons, they have to give 2 (two) warnings before summons and they have not adhered to their own guidelines.

I think you will find that bill will have some reference that this is a closing and final account.

I had the same with Sheffield way back. After 6 months they tried to sting me at the second property rate because the new owners had not paid, not registered whatever and the council wanted me to do the equivalent of an S172 on them and declare who the new owners were.

I advised council to knock on door of property and interview residents, and if they weren't prepared to do that I'd see them in court. Plus in that case I would be issuing a counter suit etc etc.

Needless to say they immediately backed right off. Labour council, nuff said.

had exactly the same thing happen when I moved. First thing I knew about it was a knock on my new door from a baliff asking why I hadn't responded to the letters sent to my old address. You'd think they'd have worked it out. The fact that you are knocking on my new door should give you a clue?????

Daft. But they seemed pretty chuffed when I paid the bill (plus the git of a baliff bill). I think they had their eye on my tv and car. mr visa helped out instead.

Councils - @rse and elbow anyone?

I think when they can't get the money they just attempt to sting anyone handy (targetism doubtless).

Mine used to send me bills for a farm about 10 miles away. Annually, despite me telling them it was nothing to do with me.

When I was a student (that one year when students had to pay) I paid the council tax at home (Tory council) and did not pay at Uni (Labour council).

The Labour council ignored my correspondence about paying at home etc and issued me with a final bill etc etc.

I did write to them threatening compensation for smearing my character - and they did back off - so it worked

As above really..

Oh, did you pay the £24? Do you have a telephone record that you cancelled it?
I would be shouting and screaming down the phone at them at this point and demanding a letter of apology, that they pay for a credit check, and damages for the libel.

Local councils can be a right bunch of ****s when it comes to Council Tax.

A few years back I rented a house for 6 months from April and then moved out of the area.
Being a switched-on cookie, I noticed that I would end up paying 60% of the year's CT, so I paid 50% and sent them a letter to explain this when I moved out.

Of course, I then got a whole string of letters threatening court appearance etc

Eventually I worked out it was easier for me to shut up and pay the extra month's tax (that wasn't owed) than to keep arguing.

Literally a couple of years later they saw fit to track me down and send me a refund that was (amazingly ) the exact same amount they were chasing me for for so long.

Its a fecking wind up and no mistake.

I don't think you will have a CCJ against you. What you have is a Liability Order stating that you have to pay the Council Tax. Not surprising it has been issued as the Council have been to the Magistrates and told them you are living there, haven;t paid etc, as the Court has no information to the contrary they issue the order.

Now the Council have the Order they will pursue you for payment, and if they don;t either accept the money is not owed, or get paid they will eventually go to Court to seek a payment order.

Therefore all you need to doo is to speak or probably better to write to, the Council advising them of the facts etc. If you know who who sold the property to, or rented it from, give the Council those details and they will then chase the right person instead.

And this doesn't appear on your credit record (although there are moves afoot to change this.)
