Possible loophole ?

Driving up the A9 the other day, I noticed that all the 60 limit signs had faded, not just slightly, but to the extent that there is no red circle at all, just a 60 on a white roundel. Do you think that in the event of my getting caught speeding, I could use this as a defence, ie the signs are not legal ?
Speeding is an absolute offence. If the loacal authority properly imposed a speed limit and you break it thats an offence. Of couse defective signs should be grounds for effective mitigation as well as grounds for a civil action against the local authority if you are penalised. In my case in 2001 the signs were totally buried in overgrown hedges and the pictures I offered as evidence were sufficiently convincing that the CPS prosecuting solicitor agreed they justified absolute discharge. But the fascist on the bench apparently well known for his obsession with American Courtroon dramas decided a ban was appropriate.
