OK here goes;
> I parked in a free parking layby on a high street that I don't know.
> popped and did some shopping (bought a sandwich)
> walking back to car saw a Traffic warden next to my car tapping into his PDA and at that point relised that the space I was in was a disabled parking space (the one next to it wasn't and was empty when I parked as well)
> said to warden "it's ok I'm just going"
> he said "why's that"
> I replied "I've bought my sandwich)
> he carried on tapping into his PDA
> I got in car and started pulling out of parking space
> just as I was hesitating to pull into a gap in the traffic queue
> he printed the ticket and as I was pulling away slipped it under my windscreen wiper with a shout of "served".

So my question is, as the car had/was in the process of moving as he slipped the penalty notice under my wiper is the notice "duly served" and should I just pay up and shust up (accepting it's an expensive sandwich) or do I argue??

If I argue on what grounds??

Thanks
Marcellus

It's lucky that you did not have an accident with that type of distracting behaviour from the TW. I would say by the sound of it that he put a ticket on a moving vehicle that was previously illegally parked. I am not a BiB so really have no knowledge of the law here, but it sounds a dangerous practice to me that couild have resulted in him, you or another person getting injured.

You could argue that the car was not actually parked any more as you had started to move off, engine started, handbrake down etc...

It is will known the TWs are a bit over-zealous, hence the changes that are being talked about

But in arguing that the car was no longer parked when the notice was served am I admitting that the car had been parked in the disabled space and therefore stuffed??

at the risk of being a little rude, you were parked there, so why not just pay up and learn to be a little more observant in future?

I was inolved in a similar incident a few years ago-as I arrived back at the car he was writing the ticket.I jumped in the car so fast and he was shouting"HANG ON A MINUTE-STOP".I just drove off as fast as I could with him chasing me-ticket in hand.If they cannot attach the ticket to the car you cannot be done-even if the ticket is written out.

Marcellus,

I'm sure that I saw a large scratch on the side of your car which the traffic warden made when the buttons on his clothing or his machine caught the side of your car when he placed the ticket under your windscreen.

You parked in a disabled spot. These spots tend to have large occupied wheelchair symbols painted on them and are, as such, quite difficult not to notice.

You should cough up.

You should also consider whether your actions in driving off actually endangered the TW and whether said TW might have sustained any injuries as a result of your actions. If a BiB comes a knocking on your door, due care or whatever?

I can confirm that there is no way the TW could have been injured...had you read the initial post I did clearly say that the ticket was "served" as I hesitated to pull into a queue of traffic.

Ticket now paid....lesson learnt.....no one likes to get one but ho hum the sandwich which cost £31.75 did taste good though!!
