I have recently been zapped at 82 in a 70 on a clear bit of dual carriageway.

The mobile camera was pointing towards me on a straight bit of road, pointing towards a bend.

The first still (no driver or passenger visible, nor is the license plate) shows my vehicle on the inside lane doing 82mph. There is a red square on my front numberplate.

There is a vehicle behind me on the opposite carriageway travelling away from me. There is also traffic behind me on the carriageway.

I have just come around the bend on the nearside lane.

The second shot is a close up of numberplate (no driver or passenger visible), and no speed shown on the picture.

My questions are thus:

1. Could the vehicle behind me travelling in the other direction be disrupting the radar signal?

And should speed cameras ever point at corners?

2. Is it legal to zap people as they round a corner on the dual carriageway?

3. There is no way I can identify the driver at the time.

4. The only picture I have with my numberplate visible on is a close up with no speed rating on it and a 9 second time delay?

What if any of the above can I use in my defence?

Thanks in advance!

Hi,

To answer your question, all four of your points are relevant.

To be able to answer your question more accurately though, If you can scan in the two photos I may be able to help.

Legally the operator should have gained an opinion of excess speed before zapping you. If you have *just8 come around the corner it is obvious that this has not been done, but will not win the case alone though. However, although the 'red square' may be on your number plate this is just a guidance for the operator, it does not prove where the laser has hit. If you are just coming around a corner, this also accentuates any 'slip error' which could affect the speed reading.

There are also factors such as whether the device has been calibrated/tested/operated correctly but I can advise a bit more how strong a case you have if I can see the photos.
