hi,

does anyone know if you could get done for not having insurance (6-8 points) if a) you have insurance BUT you have modified your car and not told the insurance company which would in theory invalidate your insurance anyway?

As far as I am aware you couldn't be done just for the fact IE if the police stop you you still have a valid policy. However, if you have an accident you may get stuck in a situation where the insurance company voids your insurance for this and you can then get done for driving without insurance.

It depends on the mods as to whether they will actually void the policy but the best bet is to tell them. Sometimes it doesn't even affect your premium.

Full disclosure is the key phrase here.
Insurance companies can be total tossers, so in the event of you deciding to modify your car, its best to put down on paper the modifications you propose and post it to them.
Then at least they have it in writing and can advise you on the cost, if any.
By just modifying (my personal flaw) you risk them voiding your cover cos the risk has changed.
Hope this helps.

Insurance contract is based on complete disclosure. If you don't tell them a material fact, i.e. modifications, the contract is voidable at their discretion. If voided, you have no insurance. You get convicted.

If in doubt, TELL THEM.

The other side of the coin is that it may be in your best interests to tell them. Not only are some modified car policies cheaper (seriously – I used to insure a modified Cosworth with Adrian Flux, and the premium was little more than for a Mondeo), they're also more likely to pay out for the extras in the event of a claim.

Worth getting some quotes before telling your own company, at least.

Hey Outlaw, who you calling dodgy?

AFAIK, Flux has cleaned up its act over recent years – in fact, I've had loads of reminders to pay, and received policy documents as soon as I've sent my cheque.

Could be something to do with my occupation, though...

These barsts tried to rip me off on my old car that had an "agreed value" policy on it.
I sent in photos and a complete listing of modifications.
When some idjut used me for brakes, rammed me up the chuff, they said it aint worth that amount, well give you this amount.
Tossers!
Har, but yours truly had the last laff, cos the guy who rammed me, his insurance company went bust!
And then highway insurance asked me to attend at court on their behalf so as they could recover a grand......
What do you reckon i said? LOLOLOL UP YOURS!!! lmao

Policemen (contrary to popular belief) are not all stupid.

If you have modified your car to an extent that it is blatently not what it says on the labels, you run the risk of having to answer some difficult questions when they ask you to produce your insurance.

If you are 18 and driving a ford popular escort which appears to have the noise and performance of a Cosworth because that is what you have installed in your engine bay, then even the not so bright copper may well take down the engine number, check it on PNC and find out what the engine should be installed within, then phone your insurance company to ask them if you have insured it as a Cosworth or a '1.1 popular'

It happens. I have done it, especially with annoying gobby 'know it all' little 'bolt on gits' that need shafting with the ruff end of a pineapple

Insurance companys are gits without a doubt but so are many drivers who shaft them with fraudulent claims especially personal injury. I know...

The question arises of what a material fact is and the insurance company's definition is not the be all and end all here.

Some insurance companys will try to wriggle out of a theft claim if you have a non standard stereo system even, or fog spots fitted to the front.

Most are ok especially if you have done business with them for a few years.

My car insurance went up by £0 when I declared 6 points for a sp30 of 79mph! But then again I have had th same company for ten plus years and have never got points in a car only on a bike.

You would not be committing an offence under S143(1) RTA 1988 as you have in your possession a valid Certificate of Motor Insurance. However, if the modifications were in place BEFORE the policy came into force, and you did not disclose those material facts (definition of a material fact is given under S6(2) Marine Insurance Act 1906 thus: any fact is material...that would influence a prudent insurer in assessing the risk or setting the premium' - note this is not the insurance company definition, it's the law) then the insurance company would be perfectly within it's rights to void your policy back to inception, return any monies paid, and leave you to it.

Short version, own up to mods. ALWAYS.

A few years ago I wrote to my insurance company to inform them that I'd modded the brakes (drilled discs and race pads on my track car) and the premium went up.

Later when I changed back to standard parts for a while the put the premium up again because I'd "reduced the braking performance"

I have never claimed and have spent more on insurance than on cars. I hate insurance companies.

Last year I informed my insurance company in writing that I had; fitted larger wheels, upgraded the brakes, fitted a carbon fibre twin throttle induction system and fitted a mapped Tornado chip. They charged a £20 fee at the time and this year my premium has stayed the same. I'm with Highway with Peart as the broker. Rich...

You get what you pay for. The insurance for my F355 is uhm, a little over the top but a neccesity.

When I was first calling around for insurance and I told them my age I could tell lots of companies were just palming me off.

Insurance companies really really annoy me.
