What am I likely to get?

I had, until today at least, a 4 1/2 year old licence with no convictions that I know of.
Got my first points after about a year of driving for allegedly going through a red light.
In 26 years of driving, I have only been caught 3 times
(the other 2 were speeding on dual carriageways) Edited by shuvitupya on Thursday 31st August 21:00

You were doing 47 in a 40, enough not to be too pissed off for getting caught. 42/43 in a 40 I could sympathise. Take the points and fine like a man.
Bit harsh, backing off the gas half a second late in mine will add more than 7mph. As the threshold for non-prosection is 46mph, it's the very lowest speed at which we can be having this discussion!
I'd put money on £60/3 points fixed penalty notice. In fact, if you were on 9 points I'd still back it, the partnerships don't seem to care about totting up, only money!

So if you are caught doing 45 in a 40 will you be procecuted?
I know a few people who have been procecuted at less than 46mph in a 40, could they have fought this?
Well, that's a tricky one.
Technically you can be prosecuted for any amount over the limit. However, plod can only use speed guns to verify an infraction once they've "formed a prior opinion of excess speed". So (it seems to me at least) in order to avoid nasty legal wrangles about how acurately they can assess speed unaided, the guidelines state that you shouldn't be done within 10% + 2mph of the limit (not sure if 46mph in a 40mph is just above or just below though).
These limits have generally been carried over to scamera partnerships but, as far as I am aware, they were only guidelines and only for TrafPol, so it's kind of goodwill if scamera partnetships uphold them, as they do in my area.
