Or rather the hatch back, tied.

Colleague asking me, so using the opportunity to demonstrate what a great community PH actually is!

i don't see why it should be unless your lights are on the boot lid or you can't see the number plate.
and if thats illegal i'm sure plod would be pulling over all those numpties that think strapping a load of push bikes to the back of their car obliterating all the lights and number plates is a good idea.

Any load must be secure...

The biggest problem is that if you drive with the hatch open and the windows closed you'll draw exhaust fumes into the car. Always have the windows open if you drive with the tailgate open to avoid this.

this is the exact opposite of what some car handbooks say. the ones where i've seen it mentioned in the handbook either say don't drive with the boot open to stop you gassing yourself, of they say if you do drive with it open, leave all the windows shut. (the logic being that open front windows suck air out of the car and suck the fumes in from the back)

Parts and accessories in such condition as likely to cause danger to other road users (Con and Use)Regs?. Would need proving = flapping up and down, hinges strained, likely to snap off.

Tied down and accommodating load sticking out?. Depending on overhang, offence not to have certain markings.

NO it's NOT Illegal.

As long as lights and number plate still visible, and not travelling to far.

Whats the distance covered got to do with it? Admitedly I wouldn't want to drive far with the tailgate open but I don;t see why the distance involved should affect the legality.
