Discussion
The following is based soley on a straightforward appeal against conviction and or sentence by a Magistrates Court and not on a question of law for case stated.
A person has a right of appeal to Crown Court against conviction and sentence if NG plea and in the case of sentence only if he has pleaded Guilty.
An appeal must be made within 21 days of the conviction the clock starting the day after. In the case of split proceedings conviction and then later sentence, then the date of the sentence applies.
The appeal is lodged through the Magistrates Clerks Office.
