wrong conviction code
Discussion
althogh i work in the motor trade i do some heavy goods driving occasionaly at weekends i was on my way back up to glasgow from the midlands and i got clocked by a van doing 50 in the 40, hands up my tacho confirmed this so i sent my licence and £60 , i got my licence back expecting a SP10 ( exceeding goods vehicle speed limit as we are restricted to 40 mph on single carraigeways ) but it has SP20 ("Exceeding speed limit for type of vehicle (excluding goods or passenger vehicles)" ) clearly this is wrong as i was driving a 38 ton artic ,
the point im making is do i just get it rectified or do i have a case for getting it taken off my licence completely
any advice appreciated cheers guys.

I am in a similar situation.
I was convicted at magistrates court and given an SP30 for speeding on a dual carriageway. I submitted my licence and it was endorsed, by hand. However I was given 6 points which was outside the guidelines that they were actually allowed to sentence and successfully appealed.
It was only when I got a replacement licence I found that the crown court where I appealed had successfully changed my points down to 4 on the licence, but now the code was an SP60!
Of course, some numpty in the system somewhere seems to assume that an SP30 is what you get for breaking a 30 limit, and so on and so forth. Apparantly it has happened to a large number of people. What riles me however is that of course the limit on a dual carriageway isnt even 60....!
As oppose to an SP30, for exceeding the speed limit on a public road, an SP60 is an 'undefined' speed limit offence. I believe thanks to Safespeed this SP60 code has now been taken off the list of offences so that there is no confusion. You would have thought the best way to avoid confusion across the board would be to spend 10 minutes properly training those who put forward the offence codes, or at least send them a memo!!??
I have read another post of someone in my position who rang the DVLA to find that he was told to ring the convicting court. The convicting court told him to ring the police/camera partnership. They then proceeded to tell him to phone the DVLA. For this reason I have not been bothered to waste my time in a similar way.
That said howeer if someone has been *successful* in getting the code changed then I would also be very glad to hear it!

You should not have been speeding. Why are you trying to worm out of it on some technicality
Take the medicine, learn your lesson and don't speed again. Sorry if it sounds harsh but if you speed and get caught tuff.
I drive at 50 in a 40. I know I will get done if I get caught but I sure as spit will not be going onto a forum trying to figure out ways of getting round it.
I know all this and I agree. I am not really bothered if you have points on your licence anyway it would not make you a bad person or stop you having an opinion. My point is this. First of all you said that they don't play fair. If the speed limit is 40mph and you choose (thats the important bit) choose to drive at 50mph and get caught by a sneaky camera a bib in a Klingon battleship with cloaking device deployed or the invisible man who for one day only has been seconded to traffic duties why bleat about it because the point the guy made in his post was HE KNEW HE WAS DRIVING ABOVE THE SPEED LIMIT. I am with you on the one point you did make. yes we might think it's daft that the bit of road we all know exhists in our own wee place where we drive is a 40 or whatever and you can drive on it quite safely doing 70 and probably did lass moth until for some reason only known to the mad folk in the legislative corridors of power changed a 100m srip of top class road into a 40 between a section of 70. (and they are mad for doing thigs like that BUT thats the speed limit and we have to stick to it because safdly the law of this crazy country says if we don't and we get caught we get done. SO WHAT IS TRHE POINT OF GOING ON ABOUT IT AND TRYING TO WORM OUT OF IT. Don't speed and you don't get done. As I said previously. I will continue to drive on that piece of road probably at 70mph until I have to give up my licence through old age and I will probably not even see another soul on that mystical road ever BUT If I get done I will not be on a forum asking how I can get out of it. THATS MY POINT.
Another point. If the road is badly surfaced and badly lit feel free to drive slower than the speed LIMIT. If it's a 50 and you consider that a safe speed for that time of night giving consideration to the road weather traffic conditions would be 30 or 40 thats ok. The speed limit is the fastest you are allowed to go its not a target speed.

Yes if you want to engage in a paper exercise and no you will have to wait 4 years.
For inf. SP60 is now out of the window for the recording problems that it caused.

Look, just imagine for a moment you were had up in Court and pleaded guilty to, I dunno, say an offence under the Immitating a Member of the Royal Family Whilst in Control of a Motor Vehicle Act 2005, (specifically Princess Michael of Kent) but when your licence was returned to you by the DVLA you found it had been endorsed (by hand) with a BG90, i.e. an offence contrary to Section 21 of the Road Traffic Act (buggering a goat whilst in control of a motorcycle) then don't tell me it wouldn't at least cross your mind to ask a question on here whether you should try and get it changed or not.
I don't think you've really understood the issue here. How is he trying to worm out of anything; he pleaded guilty and took it on the chin. He's simply asing what the implications are in getting the stupid error of the Clerk of the Court Dept corrected.
i rang my scottich saftey camera partnership office who told me to phone the enforcement office which issued the ticket , so i did , i spoke to a camera enforcement officer who said that i am one of many with the same complaint he said that because i am guilty of the offence of speeding in a goods vehicle i should have been endorsed with an SP10 and if i wanted i could have it fixed or just keep it the way it is for four years , so i raised the question " the offence i have been endorsed with is not a goods vehicle offence will it have any adverse effects when i try to obtain car i nsurance " he said he wasn't sure as the insurance database will have access to the dvla which will tell them i have an SP20 therefore i could be guilty of obtaining fraudulent insurance if i tell them i have an SP10 so he said i would have to send my licence to the midlands to have it sorted . looks like my licence will have to make a 600 mile round trip to have someone score out a 20 and make it a 10

Oh yes love it. MADNESS RIEGHNS
How can you be builty of obtaining insurance after making a false claim to have an SP10? The DVLA database may tell the insurance co that you have an SP20, but you have not. The DVLA database is not correct, due to their error.
What he means is, due to our incompetence they may charge you with fraud, only to discover on trying to presecute you that the case cannot be proven, as the court sentenced you to an SP10.

one of my main worries is that i seen an article on watchdog quite some time ago that people were sending thier licences to have endorsements removed or addresses changed and getting them back with some of the entitlements missing due to data input error ! i know can you believe it actually happens !
i have a full licence , CAT a,b,c,d + e which cost me a lot of money is this still going on or is it safe to send it away .

No the original post states do I have a sace for getting it taken off my licence completly.
Oh no it doesn't! It says no such thing.
By the way, I had terrible trouble trying to get a wrong code taken off my licence. The idiots had put on an incorrect offence of "driving whilst under the influence of Terry Wogan". It may not be worth all the bother in my experience.

Read the last line of the first post properly. You will see I am making a direct quote.
Please feel free to apologise.......
