hypothetical of course

drunken couple come home from pub. He takes her mobile and starts reading texts. Misreads a text as to be coming from lad next door when infact originated from her. He loses rag, marches up next doors drive, hammers on door, neighbour comes out and gets the skin round his jaw split open to the bone.

There is some real/imagined history involved, which is perhaps 30% real, 70% in lads head.

comments?, legal, moral or otherwise!

Depending on the injury level GBH potentialy GBH with intent if it could be shown that the person went round with the intent of causing that injury. If they had pushed there way in the house and then caused the injury you start looking at the offence of burglary.

Either way un-provoked assault with quite nast injuries. Fair chance of custodial (if there is space).

Assault, poss GBH.

Drunk and disorderly.

I wonder if you could find someone creative in CPS to figure out why that's intercepting a communication...

If skin has split, GBH and possible 5 years jail.

In reality though probably a few months jail these days.

yes

If they are a middle class anglo saxon hetero CofE or agnostic taxpayer, time.

If they are an unemployed druggie waster from a broken home, suspended.

Well they are nearly full up as others have said, so places must be kept open for those committing the heinous crime of HDI (having disposable income).

Most likely would amount in the end to ABH & not likely to end in a long custodial sentence either (unless they have previous convictions for lots of violence offences).

thanks chaps and VH (not saying that you aren't a chap of course VH!)

one of those funny ones where you ought to report out of principle, but don't want to drop a custodial on his head.

Shame there isn't a sort of '30 minute bo**ocking by nasty copper' - army style and that's the end of it.

I know what you mean.

IIRC there is one option, whereby you report it to the police and say you want it put on file in case of any recurrence, but you don't want a prosecution this time. Copper visits him and lays down the law, tells him he's a very lucky chappy but this is on file and WILL be used against him if there's any sort of repeat.

One of the local BiB will probably be able to confirm that, but I think that's what my Dad managed to sort when he was having trouble with an aggressive and threatening neighbour.

Just goes to show that you shouldn't scensoredt on your own doorstep!!

Realisticaly though, GBH from description of injuries, if alcohol induced could well get away with some programme and avoid a custodial.

You can of course make an allegation for record only, not wishing to substantiate that allegation with a formal statement or support a prosecution. Having it dealt with as a substantive offence at a much later date on it's own is unlikely though.

what would be regarded as a reasonable time to report?
immediately would be best I should think but what about 1 week, or 1 month?
