Hi Guys (first post on here, I hear alot of good things about it so would like to ask the experts)

I was rear ended last week in my two week old Audi RS 4 and the guy hit me at 50mph. He has admitted liability and his inurance company have also acknowledged this too.

Looking in the boot under the carpet the chassis has gone from being straigh to looking concertinered (S shaped)

I obviosuly don't want to get back in the car as I have lost confidence.

The bodyshop have quoted 3k in labour.

There seems to be three possibiliites

1) Car will be repaired with a rear chassis leg weld and it will be restored to factory standard (although the inevitable leaks will develop)

2) Reshell the car and add all the components e.g transmission and drivetrain from my old car.

3) Write it off and replace the vehicle under the new car cover I have on my policy.

I also have GAP too so I should stand to get a full list price refund if they can't source me a new car.

Anyone got any ideas how I can get them to write it off? After all it's the other parties insurance who will be footing the bill, not mine.

Thanks in advance.

Firstly get it repaired at an audi bodyshop - £3k seems awfully cheap for the work. Don't accept the insurance company saying that it has to be done at theirs - it does not. Recently had the same type of argument with Norwich Union (don't use them!!) and won.

50mph seems very high speed for a rear end - has the damage been properly assessed???

Are you the same chap from tyresmoke?? (sorry for swearing Ted!)

I took it to Audi Ridgeway Maintenance who are an Audi Apporved (and run) bodyshop.

I was straigh up there and onto them!

The car was rear ended and the damage is testament to Audi's awesome build quality.

3k is just for the labout and I make it 1 week's worth, but that's without the parts.

I have not posted on tyresmoke.

I think the problem here is that glancing at the damage, most people would never put that in 'write-off' territory. The other thing is that completely reshelling the car would be extortionate and you would unlikely to get the insurance company to pay out.

*However* you have the right to get you car back the way you found it. The people to speak to are the Audi bodyshop. If you explain the situation to them that you are concerned about the possibility of leaks, perhaps they could put your mind at rest? It may even be that they offer a long term guarantee to the work. However if they admit it will be impossible to guarantee that no leaks will occur then you will have a case for the two more drastic options - and if they recommend that to the insurance company then you have a leg to stand on.

Hi and welcome to PH, sorry your first post was about this.

It's a sad fact of life that accidents happen. In your case the accident wasn't your fault but unfortunately that doesn't mean that you as the innocent party can dispose of the vehicle and get a brand new replacement, what if the same were to happen again....and again? Repair costs would need to be in the order of 60% of the cars value to write the car off.

The car is repairable. As somebody has said insist that the car is done at an Audi Approved bodyshop and if you need any help/advice, feel free to PM me.

Check whether a diminution claim can be done. This would be a quantifiable figure paid cash, by the guilty party on the pretense that you are likely to suffer some reduction in value come resale or trade in. It only really applies to prestige cars and is only paid in certain circumstances. I've just successfully recovered a similar head of claim for another PHer on coincidentally an Audi S4 Avant.

Thanks for the vote of confidence!

Believe me it was fast, he was sliding (all four wheels locked up) as he realised he wasn't going to stop and I heard him screeching towards me at the time.

To twist an RS 4 chassis it must have been ruddy fast.

It doesn't look much on the outside as he hit very low but on the inside it's bad!

Was it really definately 50?
I mean you were stationary, and it hit you full on, straight in the back from 50mph?

Without actually being there in his vehicle and looking at the speedo I can't say. It was on a very fast A road and I was just beginning to pull away after someone ahead had turned right.

The fact is that from that damage YOU cannot say how fast it was. Because he was braking hard and I mean hard, (all four wheels locked up , screeching with blue smoke from the tyres) his front end was low and he hit me low.

If you inspect the car from inside the boot under the carpet at the rear chassis legs you see that they are crumpled where they used to be straight. That is not something which happens at 20,30 mph.

The fact of the matter is that the vehicle is now off the road.

Last week I had a new 56 pate performance car and I want that back in the same condition. I realise that a repair is a viable alternative but to me that is not satisfactory.

Any other goods (e.g White goods) damaged in such a way would be replaced accordingly.

I have GAP insurance too on the vehicle so I should be able to recouperate any of the losses between payout at current market value and List price.

I have an M6 as a Hire car!!!

I think it probably is - cars are designed to crumple so that the crumple zones absorb the impact, rather than the people inside the car.
Mondeo's are famous for bending the rear floor at very low speed impacts and that can result in them being written off when they're fairly new (of course they don't cost as much as an RS4).
Look, here's an A4 being crash tested at *40*MPH:

It doesn't really matter what the speed was, but I would bet money that you where not hit at more than about 15MPH.

If the car does need to be reshelled then that presumeably will be very expensive - by any chance does your insurance policy replace with new if damaged beyond 50% of the cars value (or is that not relevant anyway as someone else is paying)?

I'm not even feeling sorry for you now! You do know you're supposed to minimise the other parties losses, don't you?

Edited to add: I'm not trying to be mean, but if you keep insisting to the insurance company that you where hit at 50MPH then they won't take you seriously and that may affect you achieving your desired outcome.

An RS4 costs £49,000 and your damage was £3,000 = 16% of value of car = Not a right off.

Daihatsu Charade cost £6,000, and damage = £3,000 = 50% of value of car = Probably a right off.

The cheaper car you buy, the more likely it is to be written off if damaged.

You bought the wrong car

You should have bought a Daihatsu Charade 1.0EL 3 Door Hatch.

It wasn;t 3k though, that's just the labour charges so your looking at probably max 15k with parts too.

So I spoke to the Direct line Assessor and he has informed me that the repair bill including labour will be 10k.

So not enough for a write-off but I will see the dimunition claim as mentioned above.

It will undoubtedly effect my ability to see this car.

Oh well you win some you lose some.
