Just received a parking ticket for parking my taxi on a taxi rank. Was told by the traffic warden that because I was away from my vehicle it was not a taxi!

Ticket says spotted at 1408, ticket issued at 1410. I was away helping a customer with their luggage. I have written a polite letter to the council asking them to overturn it - what do you think my chances are?

I would suggest getting the local paper and your local association involved. A lady in my area got booked when she left the car for 3 minutes to assist 3 elderly ladies to get the last few yards from the car to the meeting room they were attending. The council backed down when they received lots of bad publicity.

If the LA reject your submission then check the Traffic Order for the restriction to see exactly what it says. LA should have a copy for inspection.

From that it may well give you ammunition to take this one all the way to the Parking Adjudicator.

If you were on duty and the licencing plates were on should be overturned as you clearly are a taxi in a taxi rank. See, this is what happens when silly quotas are put onto Traffic Wardens.

Great. And lets add cowboy clampers to the list as well.

Update!

Spoke to the head of Parking Services at Taunton Deane Borough Council and once he'd picked himself up off the floor laughing, he said he would overturn the notice.

Good for him!

I would imagine the taxi is registered/licensed as such with the LA and as such it would be very simple for the LA to check the authenticity.

So what does this comfortably paid, generously pensioned MANAGER of a PUBLIC SERVICE organisation propose to do, to ensure that the organisation he is ACCOUNTABLE FOR, doesn't harrass other legitimate hardworking members of the public in the same way in future?

Overturned or not, he deserves the shit publicity for fostering a culture where this kind of illegal harrasment happens every day.

I think he has done the honourable thing, and if he deserves any publicity it's good stuff. What else do you think he can do?

How about a dismissal of the Warden, or at least a severe reprimand?

To clarify.....

My taxi is licenced by Mid Devon District Council (MDDC) I was parked on a rank in Taunton (TDBC) not my area. I was away from the vehicle so technically the vehicle was not a taxi (no driver present). Whether there was a driver present or not is irrelevent in this case because I am not allowed to ply for trade outside of MDDC area. I was spotted at 1408hrs and ticketted at 1410hrs. I was out of the vehicle for no more than 2 minutes, in fact less because the traffic warden handed me the PCN rather than have time to stick it on the car. I was helping my fare with their packages/pushchair and parked on the rank because the rank was empty and the traffic heavy (ergo, out of the way). If I had been parked two wheels on the kerb on double yellows, I wouldn't have even argued the ticket.

The ticket was issued because the LA states that TDBC taxis may only park on a rank if the driver is with the vehicle (i.e. available for hire) and technically I was a) away from the vehicle and b)not a TDBC taxi. The speccy tt with wingnut ears who issued the ticket did so because I was away from the vehicle and for no other reason. I suspect the wardens are issued with 'targets' to hit each day - deniable by the council though .

I did submit a photo of the car showing reg plate, hackney plate and roof light.

Its crap isnt it....

I mean, a taxi is a taxi is a taxi - if its licensed in Taunton or Aberdeen, its still a flipping taxi isnt it? The drivers still have the background checks, the cars still have the enhanced MOT and insurance is there to cover "hire and reward".... so what is the flipping difference from one area to another?

Its almost a case of "its my little area and only my friends can play". Bloody local councils....

Maybe I need a coffee....? hehe

Yes, but in reality only because I was away from the vehicle for less than 2 minutes. Taxi drivers don't just throw passengers out, they help them too - well they do if they work for me.

Common sense should dictate that a taxi on a taxi rank should not be ticketted, or at the very least the warden should wait 5 minutes before issuing the ticket because the driver could legitimately be helping a customer.
