Yes, that's right, a whopping 36mph on a 30mph dual carriageway at 10am last Thursday. Needless to say scores of young children were mown down, drivers put at risk blah blah blah.

This car is Registered in my companies name and currently being driven by a member of staff. Do I just drop him in it or what?

If you have records of him driving it then I suspect that is what you will need to do. As the company is required to keep records and to show that you exercised all due diligence in identifying the driver. Methinks he be scre**d.

And have him shot for endangering the lives of literally millions of children, and the environment too.

The part that gets me is that the NIP isn't addressed to me personally, it just has the company name at the top. At the bottom it states:

"ONLY the person named above must complete the form overleaf. If addressed to a limited company it must be passed to the company secretary"

Well, there's certainly no one called Mr <insert company name> to fill in the form and I'm a sole trader, not a limited company, so no company secretary either.

What do I do? I'd love to complete the form but their orders are preventing me from doing so hehe

It's really pathetic, it's a 30mph limit Dual Carriageway that has large grass verges on either side and turns into a 40mph limit further up before leading onto the sodding motorway.

Not sure if it should make a difference, but maybe:

Was the speed recorded by a fixed camera that an observant driver ought to have spied in advance, or by a weasel in a van hiding in the weeds?

It's a bloody fixed Gatso, there's another one literally 200 metres after it (or before it depending which one of the two got him). He should have known better.

And hence perfect for a Tax Cam.

As sole trader then I imagine (but my company law knowledge is poor) that you wil be the b***er who gets the points if you don't name and shame... Still, rest assured, if went and raped/murdered someone and you knew about it, you wouldn't have to dob him in.

I'll be a smart arse here. If the limit was 30mph and it was clearly posted and he knew that by driving above the speed limit he risked a fine and penalty points then by doing 36mph he must have known that 36mph is faster than 30mph and therefore was exceeding the limit.

Section 172 (everybody hates it but its on the books) requires you (yup you) to identify the driver. If you don't them you will be on the receiving end.

Ask the driver why he was compelled to drive above the speed limit.

He will probably say the same thing we all do. "I was driving at a safe speed for the conditions, its was only a bit over, I never realised"

Its rubbish I know but the fact is the law is in place. It might be daft, old fashioned, too slow bla bla bla BUT we all know its 30mph and we all know what happens if we go over it.

£60 to number 11.

Ah, that's why I asked.
Unless there were extenuating circumstances, it's tough to feel enormous sympathy for someone who's failed to note a conspicuous camera. It makes you wonder what other things - perhaps genuine hazards - he might fail to notice.

What's infuriating is 2 days later I replaced the vehicle with a newer model that has satnav and built in camera detector!

Tell your drivers to comply with the law and you could have saved a good bit of money and would not need to buy camera detectors.

If you know for certain that you can name the driver, even if it is yourself, this foul fascist law obliges you to do so.

If you have any possible doubt, express it.

Sound like LanCASH£££re. If so.. he will get the Speed Course und no need then to inform the insurance company... but he will pay £120 for the course .. und will have to book day as holiday or have unpaid leave.. whatever

Hope you did not distract him from gawping at speedo by calling him on "handy free phone" just as he was approaching this scamera paperbag

You probably know the ones; Preston New Road, Blackpool.

Will they really go that far for a 36 in a 30?

It's got to be one or the other; a few million less children would be very good for the environment...

any other town or city and that would most likely be a 40mpg limit.

The amount of Gatsos around Blackpool really pisses me off. I drove to Barrow in furness the other day along the M55 > M6 and then the A590 before driving a little around Barrow. In all that distance I encountered two speed cameras, which were relatively new, on the A590, not far out of Barrow. And that was it, two!! Yet in Blackpool you'll encounter five on one stretch of road, of which 4 are relatively close to each other in pairs.

No idea of the definitions here, so I am perfectly placed to post...how does a sole trader have employees? Isn't that a contradiction in terms?
