Making a Prohibited U Turn
Discussion
I can't believe this, i've just received a penalty charge notice for £50 for doing a U turn !
I saw a no u turn sign at a junction, so continued until i saw a large wide driveway to a company premises moved into the right turn lane, and did my u turn there.
Do i have any comeback against this? or am i stuffed for £50?

You know what, I never knew they had cameras for that!
It would be a junction observation camera, not specifically for U-turns.
I can't find anything in the highway code for no U-turn signs other than what they look like. I know sometimes a no U-turn sign refers to a length of road rather than just a junction, but how the signs define that I confess I don't know.
why does it say BBC Worldwide in the photo? Are the BBC working for the council now?
or is that the name of the location?
more seriously it looks like you can tick box 2 on the "excuses" section and take a photo of where you made the turn.

The "return to" address looks dodgy to me. Could be a scam. I'd run it past the Police before I paid up.

The prohibition from making a "U" turn applies to an area. If this is a simple junction rule then provided that you do not U at the junction - but elsewhere - there is no offence. As there is no come-back on the council operator for issuing an incorrect demand then you might still get one.
1. Check with the concil what traffic order is applicable and that will have the scope of the prohibited zone.
2. Check traffic signage was correct for the prohibition granted under the order.
3. Check where you u-turned (inside or outside prohibited area)
4. Pay up or challenge accordingly.
5. If the notice is incorrect, then:
(a) seek costs for your time
(b) seek damages for stress
(c) ask for the operator to be disciplined for actions
(d) write to your concillor, complain, ask for investigation, inform that you have written to the papers
(e) write to local papers about the fraud attempted by a council employee and say that your councillor is investigating, suggest that they ask him for a quote
Just a suggestion

You've received a photo of your car driving, late's say East. Camera man saw you driving West moments earlier. Puts 2 and 2 together?
You don't say how far down the road the entrance is where you did your U. Could you argue you turned round in the entrance? Presumably you could have turned right into it? Or will they have film of this too?
Does seem a bit odd.

What would happen if you just replied that you were not the driver at the time?
I know thw Police can use Sec72 to require the you to name the driver, but can the Council do that as well?
What would be their likely course of action in those circumsatnce?

The document isn't a NIP, it is a penalty charge.

I appreciate that, but surely the driver is liable for any penalty not the reg keeper?

If this is true (that the no U-turn sign relates to an area, rather than the junction/central reservation gap immediately adjacent to the sign, as I always believed was the case) then exactly how is a road user expected to know at the time they're driving towards the sign what constitutes the prohibited area for that sign?
