Parked the Griff in a car park in docklands yesterday, left the ticket on the dash, when I returned to the car the ticket had somehow blown from the dash and the car had been clamped. Even though I had my ticket I still had to pay £85 release fee plus £5 for using a debit card, The attendants in the car park record all reg numbers of vehicles that pay so there should be written proof that it was my ticket but it was clamped by an outside company.

I will be appealing against the charge, do I have any chance of getting my money back? Anything I should/shouldn’t put in my letter?

Yes, threaten them with wrongful loss of use of your vehicle, extorting money wuth threats illegally, nervous strain due to last, and of course damages for all above. Lay into the barstewards!!!! with a good lawyer who is also going to make them pay!

The day I moved house we got stitched £260 by a couple of thugs (clampers). Parked a van for 5 minutes whilst we moved a big desk into it. Went back for the chair in that time we were clamped. CNUTS!

If that wasnt bad enough the chap parked next to us also got clamped and it was his wedding day...

I could have quite happily shot the short arsed goon without a second thought.

The absolute scum of the earth...

Don’t think I can afford to consult a really good solicitor.

Annoyed though how they put the chain through the bottom wishbone, then just pulled it out scratching the finish on it, now not really a problem on mine as it’s not the cleanest car but surely they should have made an effort not to damage the finish etc on it?

Get some nice sturdy clamps and clamp thier van all 4 wheels though not just one

Well the blokes that clamped us I was considering spending a few quid on some chains and lengths of scaffolding and clamping them inside their depot...

Know exactly where you are coming from there Rich.

But it does make my blood boil that proper cretins like them can obtain money with menaces because the government cant be arsed introducing a license system to cover thugs for hire.

Well I had to pay the money to get it released, I will appeal though as I'm not writting off £90, thats half towards a track day

I feel sure that they have now introduced a law to licence these mercenaries
They have to check pre cons etc and register

The local MP for Harrogate kicked it off after some w--ker up here started to blag all the local shops and places with off street parking
He errected small signs (some say they werent there till you came back!- no he wouldnt do that would he?)
Hed wait behind walls until you parked and left then leap out and clamp.

He even marched one young woman (in tears) to the local speed bank at midnight!

It caused outrage locally - radio interviews and newspapaper article
He had no remorse and thought himself highly amusing!

I was in a restuarant and saw the yellow tow truck lights outside - went out and saw him clamping - asked if where I was parked was covered by his signs - arse wouldnt give me a reply. Said" it was my risk if I chose to park on someone elses property" High and mighty short arse!
I think it was a height complex
So I wished him a pleasant day and moved my car - went back to rstaurnat then spent next 4 days working - with town center manager - visiting the shops and explaining what he was doing and how the permission to clamp was hurting their reputation and the towns.
Most agreed to remove his signs and permission
Still he went on at the other loactions and even got on one of those watchdoggy type programmes

Word has it hes now on the run fom the s - some warrant for assault

I wish him all that comes to his type

NO NEED FOR A SOLICITOR

Keep the ticket you payed for, go to the county court and take out a small claims action against the clamping company, not just for the money you lost but slap a bit onto it for loss of use of the vehicle, and the time you spend filling in the forms. £300 should do the trick. It will cost you 10% of the claim you wish to register. The court staff wil advise you what to do and how to do it.

The court will send the bailifs around to harass the clampers if they do not settle. That should be fun to watch!!

Sorry to hear of your woes.

If they've damaged the coating on wishbones would that be criminal damage then?

I have been misclamped twice now. In both cases had to pay the release fee then write to their head office (they must provide you with an address if you ask for it) and they refunded the fee without quibble. They'll use excuse about requiring to clearly display ticket being your responsibility so doubt if it'll be a tight case to claim for non-use of your car. But you can claim for damage to paintwork. Might be worth sending a written complaint to the police. Doubt if they'll do anything with it but it's ammo for you to use. If they deny then an option open to you is the small claims court (see also www.moneyclaim.gov.uk/csmco/index.jsp ) but burden of proof that they caused it and not caused by someone else or stome etc would be yours and potentially difficult.

It's a pain in the butt for sure, and depends how far you want to take it. You could try writing to whoever's land you were parked on and complain to them.

All ends up being hassle you could do without.

They will probably argue that the terms were 'pay and display' so if the ticket was not 'displayed' you didnt keep to the terms and conditions of use of the carpark.
most of them now carry cameras to photograph vehicles to prove that they were not displaying a valid ticket - its worth writing to the company stating what happened, reg no was recorded at the entrance, you might get somewhere but if you are lucky you may only get half your money back. depends on which company it was???

Not much consolation for you I'm afraid but here (Scotland) private clamping is illegal, having been ruled as extortion years ago. Surprised that wasn't the same down south.

Technically got you bang to rights

I dont think that you will get much joy in getting all of your money back, you might get a % from them if you write to them.
