Having a car crushed - legalities
Discussion
Just a quick question for a friend. If the police or council tow away and crush a car which appears to be abandoned - do they inform the DVLA that the car has been scrapped or is that down to the owner? In other words regardless of the crushing would the car would still exist on the road in the eyes of the DVLA? In which case it would require being taxed unless declared SORN or scrapped.
Cheers for the help,
Cheers for the help,
I don't know exactly but I had an old Honda Prelude (a real wreck I crashed it a lot) parked in front of my house I forgot to tax it and they took it away. I phoned them up and they said they would crush it if I didn't pay to get it back. I said ok crush it as long as you don't charge me for curshing it. He said no but could I send written authorisation to speed up the crushing process! I told him to get stuffed and put the phone down and I never heard anything back about that car from the DVLA for tax or the bastard car crushers.
I would imagine that the onus falls on the council and also the scrap yard to keep records of what has been crushed and when. After all, if the vehicle has been abandoned then you can't expect the owner to be arsed to tell the DVLA that it's been crusjed, or even for them to know what's happened to it.

It would have to be registered in first place.. und DVLA no doubt if no cash VED paid would send menacing letter und fine in post.. und threats to clamp/tow/crush vehicle .. per that advert on the telly ....

You mean the great add that shows a car in someones back garden without Tax and how evil that it is to tax a car thats not even on the damn road?
You can have an vehicle in your backyard, clear of the road, and not pay Excise Licence.
What you have to do is notify SORN (FREE) yearly.
No power to seize an unsorned backyard vehicle.
As far as I am aware Council notify Reg Keeper crushed if they can. Obligation on Reg Keeper to notify DVLA scrapped and forward V5.

What tends to annoy me though is the fact I HAVE to tell them the vehicle is off-road - what difference does it make?
If I'm dishonest I'll just SORN it and carry on driving anyway or just not register it in the first place.
Seems a bit like having to declare that even though I have a penis and therefore the means, I'm not going out to rape anyone today.

SORN is surely a slightly more subtle way of using ANPR to pick up people without the usual whinging about being picked on?
If you SORN a vehicle and use it; chances are a camera somewhere will pick you up and wham, fine etc.
When this first came in, I thought it an absolute joke; have had two cars over the years that had periods of being off road and never used on the highway, now though, I have absolutely no problem with it.
Cant really see the fuss to be honest, it should catch more of the little scrotes that make the rest of our lives a pain.

I absolutely agree, and this is a perfectly reasonable way of doing things. My query is why you need to SORN a car yearly if it is kept off the road? Why can't you simply SORN a car once, and if/when it is taxed the SORN status would be removed?

A bit of a random guess, but I imagine that the yearly update thing was to allow a simple integration of SORN into the existing tax disc/reminder system.
Also if you have to SORN yearly it is easier for them to to demonstrate that you wilfully used a vehicle on the road without taxing it, rather than "forgetting" to tax it. The whole point of SORN is that in order to avoid paying tax you have to deliberately go out of your way to SORN the vehicle, and then use it on the road, thus making it clear that not paying the tax was a wilfull act.
My vehicle is off the road 6 months a year, I like the idea of SORN as it means the DVLA know my vehicle is off the road as opposed to being a potential tax dodger.
