Just want to know the reality.

I took a pix of inside a speed camera van and thus the face of an operator/officer.

He said if I published it(and I am not) I would be breaking his copyright, but surely I have the copyright and can do whatever I like with it.

What is the law on this ?

Thanks

If the van was parked in a public place, you can do whatever you like with that photograph, except perhaps use it to market a product.

There are no laws governing photography in public places. If the operator doesn't like it, he/she should get another job and stop crying.

the person who takes the picture owns the copyright to the picture, if say selling pictures commercially, there might be a grey area and likewise if selling pictures of models in a portfolio - model relsease form is needed

there might be legal hassles if the picture identifies the tard in the scamera van and links him to personal details...if it was a simple picture with a factual statement along the lines of picture taken with xx camera and using x, y, z settings of an operator in some place, not too bad, but to suggest the person in th picture was some sort of not nice person.... that's libel

Breaking his copyright...

Hmm, so when the paparazzi take photos they run along afterwards and get the persons permission to use the photo as they wish...

If you take a photo at a football match, you have to go around and get the signatures of all the players...

...and the crowd too!!!???

I am afraid he is talking absolute rubbish - and considering he is making a living taking thousands of pictures a day of people without their permission, it does seem as if he doesnt like the same done to him!

My thoughts precisely! Next time anyone gets a NIP in the post, just tell them that they are breaking your copyright so therefore they have no evidence that you were speeding! laugh

Just mention Brunstrum using that headless biker without permission.
Might shut him up.

Quite!

My thoughts were more on

"Did you just make that up, or do you really believe it!?"

Thanks for the replies, that's clear.

I am not really sure ... I did only take it so I could see what was in the van, just for personal use.

If anybody is desperate, shoot me a PM with your email and I will send.

However, I have the copyright, so you can't publish it, LOL !

I think their pictures should be taken more often. I'm sure they use the phrase so beloved of the control freak "if you nothing to hide, you've nothing to fear". Let them see if they really subscribe to being photographed... rolleyes

Beautiful, I can't believe I'd never thought of this before!

If everyone takes a close photo of the inside of a camera van when we see one we might be able to make every Scamera Operator as paranoid as every motorist is, then there's a chance that people will decide that maybe they don't want to do that job anymore...

Good idea. If the camera operators were constantly having their photo taken by "passers by", it might well make them think about the job they are doing & if they want to continue doing it.
Would be very hypocritical of them to complain, IMO.
