being new to pistonheads, i apologise to everyone if this thread has come up before! its just ive heard many different answers from many different people.

at what speed do you need to be travelling over the limit to become eligable for a ban/6 points etc... have heard its 30mph over any limit (60 in a 30, 70 in a 40, and 100 on a dual carrigeway) but have also heard (and read) of people gettin sent to court over an 85mph hoon on the motorway. ive heard also that its double the limit, but that doesnt work in my books.

have been pulled before for doing 59 in a 30 limit, at night down a forrested country road, given a S59 and told 2 slow down a bit. discovered i had been racing for 9 years after a long patronising speech about oversteer/understeer, and weight distrobution. then went on to say, well you should be familiar with the dangers then!

so please could you give me a sane answer, so next time i know what limit i can give it beans to, w/o having to dig out the suit!

p.s sorry if u think its common sense, but its really digging at me

It will depend on the circumstances. A busy wet Saturday on the high street will attract different enforcement from plod and different sentencing from magistrates from a blat on a deserted open road with good views, regardless of the prevailing limit.

You can be banned for 31 in a 30. There is no speed at which you can't be hauled in front of the beak except below the number in the red ring.

However, prevailing practice is very roughly along the following. 6pts / ban is starting to be considered at the level of:-

41 in a 20
51 in a 30
66 in a 40
76 in a 50
91 in a 60
101 in a 70

There will be plenty with stories of getting done below that, and getting away with it above that.

There is a buffer zone of 4-5 points before this, after the FPN system stops and you'll still get to see the three wise men. This is broadly 10mph below the number, but the choice of nothing vs FPN vs court appearance is very much at the officers discretion around that level.

If you don't want to take your chance with the "random and capricious" nature of justice, then don't break the limit. Or at least don't get caught. Again.

cheers 7bd! will take your advice and will be a bit more vigilant so im getting the idea that the penalty is based on conditions/attitude/which side of the bed they woke up on, then? as living in north wales seems asif there all having sleeping problems. and also is there a speed in which the police can physically call for backup, and arrest on stopping? just curiosity btw! dnt speed that bad! honest

Two things to consider:-

Police case disposal -- does the nice officer ream you a new one and send you on your way, get out his ticket book or opt for a summons?

Magistrates sentencing -- if he goes for a summons, "cos it's too serious for a ticket", then the mags have two jobs - deciding if you dunnit, and sentencing. Their sentence is based on all sorts of things, including the speed, any mitigating or aggravating factors of the offence (busy?, wet?, rushing to see dying father?) and any mitigating or aggravating characteristics of the offender (guilty pleas, genuine remorse, on bail).

There's a little wiggle room in each of these for justice to be done, but also for the bed-side-exit to influence. Discretion can be shown. Within reason.

Plod can always call for back-up, but you're unlikely to be arrested for speeding unless you're being really awkward. Dangerous driving, failure to stop etc etc might get your collar felt.

Sorry to hear about your predicament. At least you're not Welsh.

thank f**k you didnt presume i was welsh! forgot to make it clearer but cheers 4 the info! still hoping that brunstrum gets it, need a new guy for the job! and have any of you wondered why the council allways sets up, 'road calming' 'speed detecting solutions', when most of them are greenies who want to get rid of the car, forgetting that their job is to improve the road systems, for the 'increase of cars and pedestrians' that is occuring? ooooh it just makes me steam....

Depends. It seems that sometimes you'll be given an ice cream as punishment and at others you'll get the death penalty. It's very consistent.

He has my sympathy too, but if anything ought to be up anybody's arse, it should be big, with a lot of sharp corners, and that fellow at Colwyn Bay should be on the receiving end. mad
