I have a scooter for around london. 3 weeks ago I parked in a bay that had a G-Wiz parked. Normally as long as the meter is fed I can park alongside a car in a single bay. With the meter reading 0.00 and a G Wiz parked free of charge (they are congestion zone exempt and park free too) I assumed my scooter could park free of charge as well. I contested the fine and am now considering a formal representation. Prior to taking the next step I thought I would post here and see what feedback anyone has. My view is that a scooter should not start paying for a bay that is technically free to a type specific car. Would not putting money in the meter constitute feeding? Cheers Chris

Surely if the bay is occupied it is occupied. What you may have done is stolen a 'free' space.

It depends on the borough.

This from London Bike and Scooter (I assume they know better than I):

Parking is generally much easier with a bike around London than a car but there are a few things to consider.

You cannot park anywhere, you can only park a bike
  • in a designated bike park
  • on private property (for which you have permission)
  • in a car park with space set aside for bikes or areas not taking up a paying car space
  • on a public road, subject to the same rules and restrictions as cars.
Hints & Tips: make sure your bike is fully within the bike park area - you will get a ticket for parking on the edge.

You cannot park
  • on the pavement
  • in bus lanes
  • on any parking restriction that applies to cars (yellow lines, red lines etc)
  • on private property without permission
  • anywhere that will cause an obstruction
Varying regulations

Bike parking regulations vary all over London depending on the council. Some London boroughs allow...
  • bikes to share a parking-meter space with a car as long as the space is paid for
  • bikes to park in residents parking spaces
  • bike to use a Pay & Display car space as long as it's paid for at the standard rate [/i]
So it appears that you can't park free alongside a G Wiz.

Ermm...confused. The G Wiz had paid it's "zero pounds", so the space was paid for.

I agree Tigger1. The bay had been paid for so why should I start paying for my right to park in a space that was already occupied? Westminster permit scooters to park in metered parks free of charge when they are occupied and paid for by a car. In this instance the vehicle parks free of charge. Looking at it another way, I suppose if I paid for the metered bay and a g wiz showed up the car would park and my charge would be covered. The only difference is who parked last. Does this make a difference to my arguement? I need a solid arguement in my favor. All thoughts would be welcome. Cheers Chris

I do believe, if you pay for a space and squeeze say two smart cars into it, providing both are in the space no offence is committed.

You pay for the space, not what is in it.

Sorry Streaky, I disagree...just ask the DVLA what they charge for a tax-exempt classic car...zero pounds.

[quote=http://dictionary.reference.com/search?q=payment]
pay-ment
–noun
1. something that is paid; an amount paid; compensation; recompense.
2. the act of paying.
3. reward or punishment; requital.
Don't see why paying "zero" is non-payment. User goes to meter, parks car, puts in zero pence, and leaves...job done.

In the vernacular, I can't be arsed to argue and have no desire to pick a fight with anyone less well-armed than I; but suffice it to say that "to pay" is an active verb - Streaky

so the Gwizz can part FOC and have the whole space to itself.

seems kinda pedantic and over zelous to ticket you for sharing the same space.

Serves no purpose.
