outside my work place there is a parking bay, which is pay and display, but at 4pm it becomes a clearway, at 1559 on thursday last week my colleuge went to move his car and there was a traffic warden there she stud in front of his car and held him there untill 4pm at which point she issued a ticket and threw it into the car!! what can we do, this was entrapment and obstrution of a law abiding citizen!!!

Assuming it was a council parking attendant (which I would put money on), they have to issue the ticket by either handing it to the driver or putting the ticket on the windscreen. And that's leaving aside the fact that the obstruction is blatantly not on.

Personally I would write to the council making both these points. But http://forums.pepipoo.com are the experts.

And if it really happened as described, I would think about telling The Sun as well. Absolutely scandalous.

Write to the council and tell them to shove it.

And make a formal complaint about the traffic warden, even going so far as a complaint to the police about "assault" - as not allowing a person to move their car could be seen as threatening.

What is is about everyone here and assault FFS?!

It does sound very dodgy but in his position I would move the car at 10 to, just to avoid any possible "opinion" questions about the actual time...

It's quite a "wide" law, proof is easy, and it applies in many cases where proving a greater offence would be difficult?

Then it wouldn't be assault but behaviour likely to cause a breach of the peace or similar. Where's bib when you want them smile

what kind of a nerd are you that you ever need to actually spell Occam / Ockham ? wink

I prefer "Daves Razor" anyway, I use it at work all the time.
