Parking Ticket Advice
Discussion
Guys
Just looking for a little advice.
When parking my car in an open council car park in Burton Upon Trent I had to wait 10 mins for a space. I paid for 4 hours & off I went. On my return I spotted a parking ticket.. gits I was still within the paid period? When I read the ticket it said I had been done for parking outside a bay? ie I was 25% over a white line. However when I parked the car I was between two cars. I sent a letter to the council explaining what had happened but they told me where to go & asked for the full £50 fine!!!!
I really do not want to pay this fine as I parked in an available space without causing any other inconveniences to others.
Should I appeal again & risk going to court?
Any advice would be appreciated.
Cheers...

You are not trying to corelate causing inconvinience and parking safely with modern parking enforcement are you? Those days are long gone - they want your cash and as you parked contary to the regulations then you are guilty. I know its not fair,I know its not common justice but what do you expect in todays britain?

If I really wanted the £50 I would go to court and fight til the end. I think you have a very fair argument and the magistrates may agree with you.
If I didnt I wouldnt!
I think you will find Justin that poster has infringed an Off Street Parking Order of the Council and as such has been issed with a Penalty Charge Notice (not a Fixed penalty Notice) and as such his avenue of appeal with be to the Parking Adjudicator and not through Mags Court. Details of appeal, I understand will on the Ticket.

It was not parked on a public highway, so a S172 requirement to name the driver cannot happen. The penalty lies with the driver, not the keeper, and then only if the driver admits to being the driver. If the OP says he/she was not the person who parked there, where is the evidence to proceed in the civil court against the un-named driver?. The driver, not the keeper (if they are not one and the same, and where's the evidence for that) is the person who is deemed to have acepted the contractual terms for parking there and thus the only person who can be pursued for this alleged breach of contract.
Not strictly true Peter.
What you state may well indeed refer to those little areas of PRIVATE land where parking is permitted under signed conditions and managed on behalf of the owner by an enforcement company.
Here we have a LA Off Street Parking set up which will have the force of an Order made under Road Traffic Regulation Act 1984 and which set all ALL the conditions applying, offences, costs and appeals - Parking Adjudicator. Whilst the Order will refer to the driver it most likely will have this clause within:
"The Owner of any vehicle issued with a Penalty Charge Notice may be required to give such information as to the identity of the Driver of the vehicle on the date that the notice was issued as he is required to give in accordance with section 112(2)(a) of the Road Traffic Regulation Act 1984."
