Hi guys,

I was pulled over on weds 11th july for doing 115mph in a 70mph speed limit. Weather was dry as a bone, 7.25 in morning, hardly any traffic on the road, i'm nearly 25, no points in 4 years of driving, got a good job which i need my car to get to, what can i expect??

I am awaiting the court letter but i am sh*****g myself about the prospect of a huge ban!! Any help or suggestions for court will be greaty appreciated as i need all the help i can get.

Thanks all.

A good barrister will help you achieve the right balance between lenght of ban/points and fine.

I guess as you have been pulled over you did not offer a reason for doing that speed, e.g. late for a funeral, chasing terrorists etc.

Mine argued for a 14 day ban which would not jeopardise my job as i would take the holiday, also a letter from my employer confirmed the graveness of my situation if i could not drive.

Take it seriously - cos it is...

good luck

Well i have a barrister ready to help as soon as i get my court letter and i have a letter from my employer also. I am going to admit that i was driving too fast etc....

Just bought a new car too - Gone from a corsa 1.2 to a golf gti 1.8 20v turbo - the corsa used to shake at 70 but i can get to 100 in the golf without even realising!!

I suppose i'm going to have to settle for a short ban then??

Although this is tongue in cheek, this is true!

If your employer is already to be supportive, and it is at all possible to get though say a 14 day or 28 day ban though public transport/taxis/ holidays then you have a simple equation to work out.

When you meet the magistrates for the first time you have two ways forward. If you are presentable and sincere then it is perfectly possible to represent yourself and if you are genuine then the magistrates will appreciate that.

On the other hand if you march in with a solicitor to say the words from your mouth, then this shows two things.

1) Why cannot/does not this guy want to say this himself? Is there maybe more to this than is skilfully put forward?

2) This guy has the disposable income to afford a specialist solicitor.

Either of those dont do you any favours when deciding how genuine your 'remorse' is and how much you can afford for a suitable fine.

At the end of the day the deciding factor will be whether you have a good or a bad 'bench' deciding your case. That you cannot control, but by using a solicitor, all you are doing is adding £300 or so to your fine before you have started, and there is no guarantee that they will reduce your fine/ban at all and in some cases (as above in pt 2) can make the outcome worse!

My advice is that if your observation is insufficient to spot the copper or the scamera, it's insufficient for driving at 45mph over the limit! yes

As for the court - plead guilty, apologise profusely and get your employer to back up your 'lose the job' story if you're banned. judge

Some abrasion from judge

Do you have a train/bus timetable handy..? If not, better be looking for one, I'm afraid.

As for heading-in with a Solictor, best to avoid it if you can put together something coherent as to why you we're doing 115 in a 70. Don't think any mitigating circumstances will do ("dry as a bone, 7.25 in the morning, hardly any traffic..." won't help at all.)

Didn't Vesuvius 996 post a very useful crib sheet of what to wear, look and say in court. (WO a brief)

In reply to you question, what to expect. Exactly what you deserve.

He'll just get a kick in the bum and told to be on his way a little more slowly?

I would have thought that what he'll get is more likely to be a short ban and few hundred quid fine...which is harsh, and not really what is deserved if the car was capable, roads were clear and nothing dangerous happened (OK, it was "careless" to get spotted goind 115mph).

You'll get a lot worse than if you had broken into someone's house and stolen 10 grandsworth of family heirlombs to feed your heroine addiction.

Welcome to GREAT britain.

I got a £250 fine + 5 points for doing a shade under a ton in light traffic on the M3.

I reckon you'll get a 2 or 3 week ban plus a few hundered pound fine for doing over 100mph.

I believe that you can get a maximum sentance of 14 years for Burglary, probably a sentance that isn't dished out very often but a possibility nonetheless.

If this is up to date and correct, http://www.sentencing-guidelines.gov.uk/docs/MCSG-...

Then pleading not guilty up to 110 mph could get you 28-56 day ban or 6 Points.

So it really is horses for courses, take you chances and your punishment.

Now, let's think about this for a second. You were knowingly doing 115 in a 70 zone. OK, you claim conditions were fine; that's a subjective appreciation. You also know what can happen if you get nailed at that speed. You took your chances, you got caught. Life is tough.

Whether 115 (or 100, or 90) is a reasonable speed limit in our m-ways is another issue. I do agree the 70 limit can be low on many circumstances and 80-90 limit could be better suited, but until that changes (if at all) we will bite the bullet if nicked.

It’s all a bit disjointed

Ride a motor bike on a common fine = £100

Drop a fag But on the floor Fine = £75

Dog does a dump on the pavement = max £ 1000

Drive just above the speed limit once £60

Drive just above the speed limit twice £60

Drive just above the speed limit three times £60

Drive just above the speed limit four time £60

Won't using a barrister simpy get the magistrate's back up?

You know you are guilty and surely speaking for yourself, apologising profusely and maybe a covering employer letter about your job might suffice.

An employee of mine did that and even took a copy of his current massive debts to show that loss of a job could well cause him to become bankrupt, at a time when he was trying to repay them all.

Having said all this, why risk it in the first place, if your lifestyle and job are so important?

- and no I'm no angel either!

also depends what you where driving.

if it was a metro 1.1 LE then you might get a warning.

if it was a ferrari then they will throw the book at you.

ironically the fezza was designed to be safe at these speeds but since your a flash git in your supercar you deserve it, right ?

MMM... cant say i have any sympathy - not that you asked for it.

As you were knowingly speeding "sorry guv my new golf's quicker than me ol' corsa" wont wash!

Your eyes work and you can see your speedo, especially with all them lovely blue vw dials!

YES i believe 70 is a joke in todays cars i do think that 30 should be changed to 20 in cities and villages and 10 around schools etc..... but the LAW disagrees with me, and you it seems.

You are 25mph from DOUBLE the MAXIMUM natioal speed limit for our country!!

PRAY the mags dont se it from that side.

Dont mean to be harsh buddy but thems the breaks!

I have strayed over the edge , as have most - however if its accidental we feel hard done if its intentional then we seek escape for our actions???

sorry buddy... i guess you grovell......................LOTS!!
