A mate of mine who runs a grocery store in a nearby village has just been let off of being clocked by BiB at 109mph on the A120 near Braintree in Essex!
He was going to a Jaguar track day at Silverstone in his XKR. It was about 7:30 am and the dual carriageway was clear on a Sunday morning, with the exception of the Volvo estate that nicked him. He had the sense to behave in a civil and respectful manner to the arresting officers and explained at his court appearance that he made deliveries to elderly people in his village and that a ban would lead to their suffering, as his business partner was unable to drive owing to ill health. The Judge took all this into consideration (the BiB had noted his politeness and contrition and had actually made a point of saying that, whilst he was clearly speeding, his driving was in no way erratic and appeared well-controlled) and said that the circumstances did not warrant a ban, but that he should cop for six points and a fine. He now holds the record for the fastest nick without a ban in Essex!

He is a superb driver and this whole story is about humans reasoning with humans - a Gatso nick would have seen him off the road for a long time, no questions and a lot of old folk would have to go without their Ovaltine...

I don't think the gatso would have been much use commenting on his well controlled driving though.

A ban is avoidable regardless of the speed. It all depends on the situation. Your heading 'let off' is not true-he was slapped. the fact he avoided a ban is no great achievement. Happens every day. I know of collar where the speed was 53mph over the posted limit and no ban was applied.

Not necessarily.

Hypothetically, what penalty would he have faced if he was pinged by a Gatso at 109 but decided not to respond to the resulting NIP ? scratchchin

Long long time ago I was caught at 115mph in an MK1 XR2 in Cornwall at around 2.30am. I was 19 years old on holiday with my G/F and visiting St. Ives to see where my parents had taken me as a kid. I explained all this to the PC who was following me, and at the time my G/F was asleep in the car, and the officer was quite relaxed about it all.

Anyhow, he explained that the dual carrigeway had gone to a singe lane (with dual in the oppisit lane), so infact the limit was only 60mhp and I was actually 55 over the top for about 3/4 of a mile.

There were no other cars on the road, I passed his breath test and said "right we need to deal with this then". He then said " I dont want to be the one to tale your licence away from you, and if you goto court, you will. So I think we will just go with the fixed penalty of 3 points and £40 fine (as it was then) and call the speed 98MPH ave (which he marked on the ticket), what do you think?

I said it would be nice just to have a producer (7 day wonder) and he told me not to be so cheeky, wrote the ticket and let me on my way.

Top policing from that chap, he was a very nice bloke, and saved me lots and lots of aggro, so hats off to him, whatever he is doing nowdays...

i got caught at 109 on a dual carriage way in hampshire a while back, got 6 points and a fine from the court (£250 ish IIRC). Letter from my boss helped a lot, saying that not only would I suffer but the company would also suffer. He was one of those really "wordy" guys that could write a great letter!

of course this was about 7-8 years ago.

Not that unusual. I posted my experience a few weeks back. Clocked at 101mph on a clear dual carriageway. Plod offered a FPN (3 points & £60) and also some advice on my observational skills. Commented that I had been driving sensibly and making progress, resisted the temptation to undertake etc.

Good to see the system working properly. boo sucks to Gatsos but then again i would have probably known where it was and avoided it completely.

More like a rabbit's foot! They joined the carriageway from an ascending on-slip just as he was passing...
