Just after a bit of advice from the legal bods.

I have just received an NIP for an offence that was commiteed in one of our fleet of HGV's.

I now have to identify the driver which I am about to do.

He has since left our employment so my question, hypothetically, if he has moved address since leaving our employ and not informed us, how do we stand?

Just forward the details that you've got. You'd only commit an offence if you failed to identify the driver. You're not doing that - if he's moved since he was employed by you, then it's up to the Police to track him down.

Ok Thanks,

It is just hypothetical, but it could happen so easily with the type of drivers we have.

So, why can't you attract the "other type of driver"? Perhaps management may be part of the problem?
