Hi
I got nicked doing 111 nearly 3 months ago, and still havent had a court summons. Does anyone have any legal paperwork saying how long I have to wait before I can breathe a sigh of relief and promise to myself not to be a naughty boy again?
Any advice will be gratfully recieved

have you had a NIP - notice of intended prosecution...or were you given one by the roadside by a traffic officer? if so it can be months - heard of one guy finally getting to court 3 years later !

If you think you got flashed by a camera at 111mph and still have had no NIP through you are off the hook - they have to post it to you within 14days

They only have to get the summons signed within six months. As long as they do that, they can pretty much serve it whenever they feel like it.

Statutory limit on proceedings is 6 months. As long as the information has been laid before a court within that time, then the summons will be valid and it can be served even years later. This would be unlikely if you are a current UK resident and living in the UK.

I would imagine that if you have not received a summons within the 6 months, then the paperwork has probably been lost and you will have nothing to worry about!

With reference to the nip the 14 day rule only applies if the cars registered to you,if you were driving a company car etc it does not apply.They only have to inform the registered keeper within 14 days not the driver

You are basically correct. The act states that the NIP must be served within 14 days after the date of the offence which in effect is 15 days if you include the date of the offence.

Once the first one has been served correctly on the registered keeper, then the follow up ones to the driver (if different from the keeper) do not have a time limit on them.

Sorry to be the bearer of bad news, but I thought I'd got away with one - it got to within 3 weeks of the 6 months when it arrived last week.

Good luck but don't bank on it until the 6 months are up.

Cheers for the reponses guys, The nice policeman did tell me I would be getting a court summons, but still nothing...

I'll keep my fingers crossed for another couple of months then
