How is the road traffic act progressing?
Is a traditional radar detector ( not a GPS device ) still legal?
If not, what is the likely penalty of being caught using one?

I talking to my local taxi driver the other day ( I do quite a few airport runs, so know him well ) who was recently stopped ( for something else ) and was told by BiB that his detector was no longer legal. No action taken, just " best you stop using it " I was under the impresion that they were still legal, but maybe this has now changed, or maybe BiB was just trying it on ( hence not taking any further action ).

I assume that if they see it in the car, it would be up to you to prove you weren't using it rather them proving you were.....

The law is planned to be changed, but it hasn't been changed yet.

Section 18 Road Safety Act 2006 prohibits the use of speed detection devices:

""speed assessment equipment detection device" means a device the purpose, or one of the purposes, of which is to detect, or interfere with the operation of, equipment used to assess the speed of motor vehicles."

Whilst the Act has received Royal Assent, at the moment the commencement order for that section has yet to be brought in.

...so Plod was half right?

DVD,
Thanks for this.
I don't suppose you know when it is likely to be bought in, or what the penalty for using a speed detection device would be?

If getting caught would be approx the same as speeding, I may keep using mine.
On the other hand, if they were going to crush my car, then lock me up & throw away the key, I may stop using it. ( Actualy, I don't use it that often anyway )

So, does this include using my eyey then?

(What, another badly worded act?)

Until the Commencement Order is made it has no legal standing. There are entire Acts which have never been put into practice, despite being given Royal Assent as no Commencement Order has been made (please don't ask for examples, I just remember the point from something like day 2 of week 1 of my legal studies!)

So the question is do these commencement orders ensure that Joe Average is made aware? Who's responsibility is it to inform the general public that a new motoring act has come into force?
I'm particularly interested as I own one of these detectors which I'm assuming will actually become illegal at some point.
