My brother got sent this today, it was my wife who was driving the car at the time. She was pictured directly outside my cousins house, who lives in a house with a drive and a bus lane the crosses the end of her drive. I have written the following letter:

Letter for Council said:
A notice regarding my car in the bus lane at *location* arrived today; I believe that the video evidence at the time shows my sister in law, who was driving the car, having just left the drive of my cousin’s house.

My cousin, who’s house my sister in law visits frequently, *name withdrawn* at number *address withdrawn* where it is not physically possible to either park on or leave the drive without crossing the bus lane outside the house. At times when traffic is busy it is safer to first reverse out in the bus lane and then move out into the flow of traffic when a safe gap appears. I believe the pictures taken at 18:43:02 and 18:43:08 show the car waiting for a safe gap in traffic having just left the drive.

I have written in order to ask that you accept this informal representation requesting you to withdraw the notice served above, I will be happy to provide you with any further details should they be required, including a written statement from my cousin, should you require them.
They are asking for £120 for this, or £60 for payment within 14 days. I'm posting to find out what the likely outcome of my letter would be, and if required what further action I might need to take, PePiPoo didn't seem to cover this. If anyone can point me in the right direction for information on dealing with issues such as this I'd much appreciate it. Thanks smile

Don't know how to help but think your letter is about as spot on as possible in terms of information, length and tone.

I agree.

Hope they pick up on reversing out into a major road...

Nah, reversing into a bus lane must be as safe as houses. I mean it's not like it'll have any traffic in it.

Do any of you know what's likely to happen next as a result of my letter?

Should the council decide to escalate this what would I need to do for the next stage?

Same as PCn for parking.

Council may act on your letter and NFA - end.
Reject your submission in which case you can either pay or take it further by not paying in which case they send Notice to Owner of offence.
You then make representation as why no offence committed as before.
LA either accept - NFA, or
Send you Notice of Rejection of Representation which will have details how to take it further to the Parking Adjudicator for written or verbal hearing.

Whilst you intial letter to LA will put the increase on hold at Notice to Owner stage the discount goes.
