Am I the only person in UK who thought points came of your licence after 3 years. Seems since 1975 its now 4 years why the change. You could beat up and old lady for her pension and not get 4 years.

with the totting up system does this mean you can have for example 17 points on your licence? 11 points for 3 years then get another 6 points? or would this be looked at with a dim view by the courts and they would propably give a greater punishment?

The court will have a copy of your driving record (not just your licence) before them when sentencing, warts & all.

I would hope this information is not available to the magistrates at the time of trial, that is before one's guilt or innocence is established.

(Naive, I know redface .)

I would presume that our magistrates are able to keep a clear mind even if they "happen" to see one's driving record before guilt or innocence is established.

(Cynical, I know redface .)

I'm fairly happy with this status quo from my own limited experience, and have found my second comment (magistrates ignoring one's prevous history) to be a fair summary... smile

Do they have a copy of your record since you started driving, or just the last xx years?
By record, do you mean just points ( inc bans ) or ins claims as well?

What's on your record held at DVLA.

Oh & they don't see it unless you are convicted, the Clerk has it until then.

Points that are no longer valid (expired), are not considered by the Magistrates.

So if you have a clean licence, but had point say 10 years ago, then these do not reflect in the sentencing at all??

Thats what the bloke states...

Court cannot rtake into account any spent points. The Mags Clerk will check the Licence and advise the Mags of what points, if any, are relevant.

If he were to state 10 spent points on Licence from 12 years ago then that AFAICR is abuse and grounds for a re-trial in front of different Mags.
