My Motorbike Accident
Discussion
Guys in the know can you help me with whats happens on the law side of the system?
I was hit on my bike by a van pulling out of a side road crossing my lane. The driver left the scene but police found him later. He statement was "I didnt know i hit him, i didnt see him"
I have just submitted a written statement and filled in a "Court availability form" from the road traffic department.
What is happening now ????
Thanks,

Get your diagram/report und take some back up photos to support claim to his insurers. If you think you have some injury as result.. see A&E. (GP not the right one to see in this instance.
) You lucky it not abroad. The "priorite a droite" take the unwary by the
(They introduce in Germany by the way. Accident stats in urban areas shoot up. The Fed State concerned claim the decision taken to slow people down. Meanwhile up in another small area in North (forget where exactly now. I did make a mental note when I hear .. ) .. they decide to remove all traffic lights/road furniture "because it worked in Holland" But check self out - make fullest report. I am sure insurers/court will sort it all out to your advantage.

The traffic officer dealing with the case will look through your witness statement and any others they have. They will also be interviewing the driver under caution, probably at his home address (sounds like they may have done this already). They will then consider what offences may have been committed and what the evidence can prove, and make a recommendation as to further action. This may then be reviewed by their Sergeant before going to a Summons unit who will make the final decision. The Summons unit will then let you know what's happening. This process may vary by force.
If the driver is to be sent a summons for DWDCA they may also be offered a Driver Improvement Scheme, which means they are not prosecuted if they attend and pass a course at their own expense. Otherwise they will go to court for it to be heard, and you may be required to give evidence.
If it is heading to court you will be sent an MG19 Compensation form. Detail any injury, costs and losses on there. The form is quite self-explanatory and while I'm sure the insurance will be dealing anyway, if there is anything they won't be recovering you can claim it through the courts. The insurers wait for any court process to be finished before they argue liability between themselves.
If there is to be no further Police action (either can't prove or decide there aren't any offences) it will be left to the insurers. All the documents from the Police investigation will be available to them.
