S59 issued on personal observation can I report . . .
Discussion
There has been debate on S59 been issued on personal observations which could come from members of the public.
You could theoretically have your car crushed for two such complaints which I understand don't have to be purely police witnesses.
Does that mean for example that the next time I am driving on the A61
and at the front of the string of traffic ahead of me is a car doing 30mph on an NSL road I can take their number and report them for antisocial driving.
Boy would I could I?

Its not just distress, the BiB has to have resonable grounds that inconsiderate or careless driving offence is involved. However, in short, the answer to the question is yes.
blimey??I don't believe it.
But surely not just by one persons evidence or report???
Ten years ago, you could execute a perfect overtake and nobody blinked. Do it today, and 95% of the drivers around you have a dicky fit...
I fear we have a tricky one here, lads...

Officer needs to have reasonable grounds for believing that the vehicle was being driven carelessly and so as to cause distress alarm etc to give a S59 warning.
How reasonable is "because a MoP saw it"?
Especially if it was an old geeza with a dodgy ticker and varifocals wearing his hat cruising along at a breathtaking 20 mph or the more usual 40 mph everywhere. God help you if you should overtake him!How reasonable is "because a MoP saw it"?
Crap driving I can understand - although how that is defined has got to be a grey area.
And where would speeding stand? Could they lodge a complaint against your alledged speeding? If you have a loud exhaust - it might "sound" like you're speeding, and unless they have a calibrated metre where does it stand.
And where does personalities come into it? If they had a vendetta against you, what's to stop them complaining about you (and their mates too).
Never ending!

my brother just got a section 59 for speeding in his van
was that issued by an officer? and why didn't he get a proper speeding ticket are you saying that if an officer now thinks you are speeding despite not having callibrated or indeed any eqpt that you can be S59'd purely on a whim. What I need to know is does an S59 count as a detected crime.
If so then this legislation is the most pernicious piece of crap ever invented to meet targets and satisfy government stats.
Possibly the worst thing ever to taint the polices allready tarnished reputation.
So its now no judge , no jury , no equipment or need of proof , guilty without recourse to prove innocence.

It's a great piece of legislation if used correctly and how it was intended (off road bikers etc being dicks).
The admission being that the blue rinsers would be acceptable witnesses to issue one.
