Looking for some advice - I have on many occasions bought from www.tradelamp.com online and been happy with their service. My last order however never arrived so I got in touch by email to be told that the business had been sold and that the previous owner had made no activities (aside from raking in the cash) for some weeks. I was advised by email by the supposed new owners to approach my card company for a refund.

My Credit card is with Egg who couldnt have been less interested if they had tried. It seems that because the trader uses a 3rd party (NOCHEX) to handle the payments Egg can do nothing. Checking the NOCHEX T's & C's they exclude any possibility of a refund. OK its only £35 but its the principle. This chap has run off with my money !. Now IIRC my contract is with the Credit card company for supply of goods purchased using their card, so although they wont offer me a refund or do anything to solicit one on my behalf I can take them to the small claims court for breach of contract/non supply of goods paid for. Does this sound right ? Any advice gratefully received before I jump in with my big boots on !

I dont have a tel number or address for tradelamp (nothing on their website) so probably best to go after the credit card co on this one.

Cheers

That doesn't sound legal - by UK law they have to put up all sorts of info (company number included). Might have been a warning sign, but too late now.

I would start with the credit card company for a refund, they should be insured against this. Threaten to cancel the card, and follow through if they won't move. I don't think I'd reach for the courts for £35...

As long as the company name hasn't changed they're still liable to fulfil your order.

Credit card co are only liable if over £100 (Consumer credit act 1974) IIRC.

For the sake of £35 it looks like its going to be more bother than its worth. I guess a report to trading standards might be in order.

Surely if you buy a company you buy their debts? I would send a letter to the company asking for either the goods or money

I've found out the details of the original owner MPW (Elecctronics)with address and tel number. Just reported them to trading standards so wait and see with them. For the current owners I still havent found out their address or name, but when I get time later on I will look up their IP address and see what I can find out. then I can report them to trading standards too! I have emailed them telling them that they are responsible for the breach of contract and therefore owe me either the goods or a refund.

Probably wont get anything back but it'll be fun rattling their cage with trading standards :-)

I am sure you are able to buy just the assets of a company, rather than the whole company.

Quite correct.

When you buy a company you take on all of the liabilities good and bad.

Otherwise the guy can just change ownership of his company each month and 'supposedly legally' not send out anything!

Write to each of the National papers, letters page. Indicate that while you understand that most credit card companies would cover you in this situation, Egg say that they will not. Warn readers to check carefully which credit card they use to make purchases under £100.

Might get Egg public relations interested.

Doubt it will for £35, considering they only liable for £100 or more as are all other card companies

try http://web.archive.org/collections/web.html for archives of the site, might even have left some info he did not mean to leave..
