Hello all,

I pleaded guilty to speeding on the M62, by post to West Yorkshire Magistrates. In the officers statement she stated that she asked me whether my speedo was in full working order which she didn't, and she also didn't have her statement signed by a witness.

In my statement that I sent back with my plea I pointed this out.

Now I've received my bits back (eventually) and I've got 5 points and £100 fine and £55 costs, but theres no transcript/details of what went on it court so i can see what was said about the police officer lying in her unsigned statement. Can I request a copy of my transcript and will they hand it over easily?

Cheers

Stacey

A BiB's statement only has to be signed by the officer concerned. If you wish to make a complaint then speak with an Inspector at your local nick.

There aren't any stenographers in Magistrates courts, so there will be no transcript.

So I can't find out what the Magistrate said about the lies in the statement or would it just be a taken that she is a good honest officer and I'm a lying child-killing speeding motorist?

You could have found out by actually going, poppet wink

5 points for an SP50 sounds like you actually were pulled for decapitating kittens while you drove along - what speed were you doing to get that many?

In general yes. The word of an officer is worth more than the average MoP. Had you cross examined said plod, the matter may be different.

I don't think, as above, Steno's are in the mags, just the Clerk and the Bench.

I would have loved to have gone along but I have a mortgage to pay, and no holidays left so to be able to afford my fine my mortgage and beans on toast every night I had to go to work.

In the fiesta too, I was just clearing out the pipes.

Not too bad apart from being skint and ready to strangle solicitors.

Your letter to the Court will have been read out to the Magistrates when they heard your case.

Looks like they were not impressed and in any case the points you mention do not corrupt the evidence that you were speeding does it?

Cette la vie mon ami.
