Question for legal types /BIB

Regarding the 2 bikers who were banged up and banned for 2 years!

In the trial the police/CPS or whoever does the procecution used stopping distances as part of their case.
The police reportedly said that it would have taken the bikers MORE THAN A QUATER OF A MILE TO STOP!

The Judge/Magistrates must have used this evidence to decide guilt and punishment.

Reading today in Fast bike magazine they proved that you can stop from 140Mph in 0.1475 miles( which is a lot less than a quarter).

Surely if a big part of the crowns evidence was wrong this trial was dodgy in the eyes of the law?

i would like to know how they got the braking distances because unless the bikes in question were tested then any quote of the distance required is purely guesswork and surely couldnt be used as a fact in court.

the breaking distances in the highway code are an outdated joke and set when most of the country were driving austin 1100's or riding triumph bonnies (same as the motorway speed limit)and im sure i read somewhere that the yamaha r1(in the right hands) can accelerate from 0-100 and back to 0 in the time it takes a evo7 to get to 60 which proves how much bikes have improved over the last few years.

whatever way you look at it though,158 on a dual is taking the p*ss realy and if it had been a car driver he probably would have got life!

this is just my opinion though.

I think its ridiculous that you can spend time in Prison for speeding. To me 158mph doesnt seem 'that' fast, especially on a superbike.

Court isn't so black and white. Well aware if they hit a stationary artic they stop in an even shorter distance, even allowing for the dead cat bounce. Jailed for what they did, not what they might, or might not, have managed.

Did that mag test include 'thinking time'? Not arguing with that result but those sorts of tests eliminate any time used for 'thinking', 'reacting', whatever, call it what you want. I'm sure a split second thinking at that speed is many metres covered.

yes it did and it said that the origonal Highway code was still close with the reaction times! i.e reaction times dont change but brakes do.
